Figures. A bunch of rich entitled guys move somewhere and start demanding that everything change around them. If the noise bothers them, I'm sure there are some non-rich people willing to live there! Maybe even some of the *gasp* little people who use the public services the monied interests find so bothersome!

Although noise reduction features in the yard would be a good idea. If the residents of that building would stop whining for them and start paying for them, they might get somewhere.

These whiners are basically upset with themselves. They realize how stupid they are for buying a condo across the street from an active rail yard. Statistic show these newcomers stay in the area for less than five years. I doubt if any action will be taken by the LIRR during that time.

The LIRR is right in this case. There is no reasonable way to reduce the noise without disrupting railroad operations. This all goes back to NYC's bizarre zoning regulations.

I hate to tell you, but there have been cases. I don't think any would apply here; it's not like situations out west where people moved in next to a farm that five years later switched to a stinkier fertilizer.

NYC has lost its industrial base. True, noise was not an issue when factories and warehouses were located in the area. Unfortunately if NYC did not change its zoning regulations than all you would have in that area is abandoned factories and warehouses - so NYC had no choice but to allow residential development.

IMO the developer screwed up big time though - knowing the conditions of the area they should have soundproofed the building and advised all prospective buyers. I see that the principle of "caveat emptor" is alive and well!!

As we discussed previously, the issue is vibration, and the best way of preventing the most severe variety of that is to make an alteration at the source that would have the effect of 'dampening the oscillations'. If they want to put their money into that, I encourage them.

Even putting aside the high ethics of real estate agents, was asking these people to look out the window too hard. Hell, for one of these buildings where the complainers live, I saw the standard online listing, and there is an outdoor patio pictured, and beyond that, the several tracks of the railroad.

And as it should be, that is the principle when buying real estate in NY State. It's up to the buyer to research these things, not up to the seller to say, "Hey, do you know that those metal lines across the street with wooden beams conencting them are called RR Tracks".

It's ridiculous. That's another perfect example. People move to a subdivision next to a farm (a farm that was there for decades), and then have the nerve to complain when the noisy irrigation starts up at 4:00 in the morning, or they spread the manure.

They are correct that it is now a residential area (their residential buildings, but it is adjacent to an industrial area (the yard and tracks).

That said, the earlier topics contain my thoughts on what the residents actually should do other than circulating petitions signed by fools.

We spread manure in our gardens. Our gardens were there long before the neighbors who in any event bought the land from us anyway.

But I *like* the smell of the manure. First it means that the manure is no longer frozen solid and that warmer weather cannot be far away. And Second, it smells like MONEY, the money we made raising and selling the cows in the first place, and then the money we will save by having fresh fruits and vegetables from our own garden.

Besides, the place IS ZONED FOR FARMING!

So I should add to my prior suspicion that a lot of this is just buyer's remorse at declining prices in the market. I don't think that either the realtors or developers were dishonest in this regard, as that much railroad is beyond anyone's capacity to hide without several shots of fairly stiff stuff.

I have a feeling that someone here is now going to make an offer on a unit there for the train views. One man's eyesore is another's dream landscape!

You are right, no one was deceived. It's quite obvious that the tracks are there! What do they think the tracks are used for?

Someone should put a link to that photo in one of the remarks to that article!

I agree with you, but a better way to rezone would to have had a buffer of retail zoning up against the LIRR yard areas Supermarkets and other large stores wouldn't care about idling diesels or vibrations. An added benefit would be to give new residents shopping locations within walking distance or short-drive distance.

On S.I. I've dealt with rezoning (really downzoning) issues with our local civic group. You must be very specific and politely forceful with the city in terms of community demands from the start. Sounds like the folks in Queens let the city dictate to them what the rezoning would look like.

One future proposal I've read about would allow for higher density zoning near subway stations. So far it's just a proposal but that's the kind of zoning issue that civic groups need to be proactive about, pro or con. It wouldn't work near the SIR stations but may work very well in parts of Brooklyn and Queens.

I would venture an educated guess that since no-one lived in that area when the zoning changes were proposed, no-one cared enough to attend the meetings. The residential area that has resulted came after the rezoning not while it was first proposed.

The trouble with retail in 'frontier' areas is that it's really hard to fill until you've got significant occupancy in the area, so developers are going to against that from the start, generally speaking.

In this case, I think that what happened was an oversight by the architect in that the vibration noise from idling diesels wasn't taken into account. What they probably should have done is to pay LIRR to install devices to dampen the vibrations at the site of where the the locomotives lay up idling. If that's the issue, it still can be remedied, although I think that property owners should foot the bill. They can charge a special assessment on the common charges in their buildings to raise the money, and that would theoreticlaly solve their problem.

If their actual complaint is that they don't like the yard, period, then either they have to wait for some change in LIRR operations, or compensate LIRR. Eventually, I'm sure that the air rights will be worth enough to consider a sale of them too.

Correct. I don't think any remedy at the yard should come out of the MTA funds (taxpayers). It should be the people in the building that pay for anything necessary. Why should the LIRR/tapayers foot the bill for their own foolishness? I am sure these condos were cheaper than elsewhere in the neighborhood.

On that, I'm not as sure, at least the original prices. (As an aside, because developers often have to obtain the approval of their creditors on the project to discount, some/many? prices haven't changed very much).

But anyway, they each bought into what they bargained for. Sour grapes came later.

When I worked the 7 line years ago, there was construction taking place in Corona Yard, and all trains were laying up on the mainline. As a result, all trains were told to lay up with the compressors off, or "cut out". I was told people in Woodside complained about the noise.

To this day, I believe NYCT does the same thing with the trains that L/U on the Brighton Line.

Why? Consideration for the neighbors. Trains make noise, so the TA did what they had to minimize the inconvenience.

So why is everyone here so upset that the "yuppies" in the new LIC condos are complaining?

The big difference is that elevated subway lines went through areas that were either developed or intended for residential development at the time the lines were built. The LIRR built in a commercial district with no expectation that they would ever have to accommodate residential development.

I have to look it up to be sure, but I believe it's called a "materially adverse change". Yes, they knew they moved in next to a farm; they expected a certain amount of 'annoyances'; those are usually written into the deed. However, when the farm one day changes production hours, methods, or crops, they do indeed have a legitimate complaint.

Yes, you're correct. But I recall several signatories to the petitions from Arris Lofts.

I haven't seen any tracks on any advertisements for One Hunters Point.


I don't recall paying enough attention to notice. But what I will say is that even if you tried to miss it on site, you would have difficulty.

I did just go to the website here, and in fact, under floor plans and views, they actually show the views from most units, floor by floor.

There are obvious views of the yard with locomotives.

The Hunters Point condos were priced starting at $600 per sq. foot. The Powerhouse started at $700 with some rooms at over $800, Gantry at $650 to $750.

I didn't check the "Views from this residence". I stand corrected. OTOH, I noticed they don't offer any views from the second floor!

Check out the views from 3-8M...I think you can see LIRR putting in the high platform!
