I have to look it up to be sure, but I believe it's called a "materially adverse change". Yes, they knew they moved in next to a farm; they expected a certain amount of 'annoyances'; those are usually written into the deed. However, when the farm one day changes production hours, methods, or crops, they do indeed have a legitimate complaint. |
