That's a crock. Juries can do whatever they want. A judge can overturn a jury verdict, but none of them are going to be criminally charged with anything,

Yes, he can "set aside" a guilty verdict. He also has the discretion of ordering a new trial or giving a not guilty verdict right then and there. That's about the only thing that could have happened had the jury found Casey Anthony guilty. It would likely have never happened, as judges are loathed to do such a thing unless there was some compelling reason, for which there was none here.

It's not a crock. They did what they are supposed to do. I don't agree with the vedict either, but they can NOT just do whatever they want. Obviously they can't be "criminally charged" if they don't do what they are supposed to do based on the guidelines they are given, but that doesn't mean they can "do whatever they want". They ARE supposed to be impartial, and act on JUST what is presented to them in the trial.

Let's just presume for one moment that she didn't murder her daughter, and that instead the death was some sort of tragic accident. One then has a picture of a very distressed mother who goes into denial about it, lies to her family as well as the police, and ends up getting carried away with her own lies. In that case it wouldn't be criminal guilt for murder, but rather a feeling of guilt and a lot of irrational behavior based upon it.

But that is of course just presuming. I don't think any of us will ever know what really happened. And I do believe that the not guilty verdict is a victory for Florida taxpayers, as they won't have to fund incarcerating (or putting to death) a woman who is unlikely to pose a danger to anyone other than herself.

Also, when you are the ones with the power to convict someone of something so heinous, you really have to be convinced beyond a reasonable doubt that that person is guilty.

While in my heart I believe that Casey Anthony is guilty, there was enough conflicting evidence which might have made me think twice if I was on that jury.

How interesting that the howling mob--the very thing our justice system is supposed to protect us from--is speaking out so loudly now that the verdict is in. Everyone seems to have forgotten that Anthony had her day in court, and we as a society agree to accept the verdicts of our courts. We don't have to like or agree with them, but we do have to accept them...

When the judge formally charges the jury before deliberation, he or she reminds them that they must judge the case on the facts presented, and on "the law as I (the judge) give it to you". That's it and that's all. But the howling mob wants to disregard that...

Juries are charged by the judge to consider the case on the "law as [the judge] gives it to them", and only those facts that were presented at trial. You'd be surprised what juries do NOT get to see or hear at trial because one side or the other has had it excluded. I don't think this jury just wanted to "go home as soon as possibe", I think they concluded very quickly, within the parameters the judge gave them, that the DA didn't satisfy what Florida's first-degree murder law provided.

For the LAST time: Juries can do whatever they want. If they choose to convict someone without the proper evidence, the judge has the option of setting the jury verdict aside. There was absolutely nothing legally binding that prevented this jury from voting not guilty. There was compelling circumstantial evidence for conviction. I think we had one too many Law & Order or CSI viewers on the jury who thought you HAD to have physical evidence to convict. The idiot who kept complaining that the prosecution could never explain how Caylee actually died is a perfect example. You don't need to know that to convict!

There was compelling circumstantial evidence for conviction.

Circumstantial evidence can convict people, if there is enough of it, but direct physical evidence linking killer to victim, presented by the DA in a clear, concise manner, is a reasonable expectation of most juries today. That's not "CSI", that's ordinary prudence. If you're going to send a person to jail for the rest of their lives (or, in fact, to their grave), wouldn't YOU want to be as certain as humanly possible that you are convicting the right person?

And, again, NO, juries CANNOT just "do whatever they want". They MUST judge the case based ONLY on the facts given at trial, and the law as the judge charges it. That's it, and that's all. If the verdict is "jury nullification", it's within those two parameters I just described.

The jury is only allowed to use information ON THE RECORD, presented to them in the trial. There are plenty of details that were "stricken" from the record, or said OUTSIDE the courtroom. The jurors are NOT allowed to use that information.
Again, I do NOT agree with the verdict, but I also do see that the jury unfortunately had to do what they are instructed to do, and they did that. For people to be criticizing BECAUSE they did the right thing, and saying "they could do whatever they want", even though they DID the right thing as they are instructed to do, is beyond me.

But it CAN be used to convict. Many times people have been convicted of murder without physical evidence. There was ample circumstantial evidence here to convict had they wanted to do their jobs instead of wanting to go home. The defense attorney pretty much based his defense on this premise: there's no physical evidence, so it would be EASY to acquit....hint hint nudge nudge.

Wrong. There was once a time when the science that provided physical evidence didn't exist. Not every trial is nice and neat, with direct physical evidence, or a confession, or an unimpeachable eyewitness.

This jury had what it needed to convict had it wanted to do so. The judge would have never set aside a guilty verdict. They chose to acquit, they were not forced to by rule.

You really don't know that for certain. You can't unless you were on the jury or a fly on the wall.

Pfft. This isn't rocket science. They all wanted the same thing: to go home. If "12 Angry Men" were to happen today, that kid would have been convicted.

I disagree; had there been ample evidence they likely would have voted guilty. Something raised doubts and hence the verdict we see today.

This jury had what it needed to convict had it wanted to do so.

You didn't even know where the crime and trial took place.

Not you have more expertise on the matter than the jurors?

Have you ever served on a jury in a criminal case, Luch?
