Yes, he can "set aside" a guilty verdict. He also has the discretion of ordering a new trial or giving a not guilty verdict right then and there. That's about the only thing that could have happened had the jury found Casey Anthony guilty. It would likely have never happened, as judges are loathed to do such a thing unless there was some compelling reason, for which there was none here. |
