Agreed, while I respect the police, I admit they have gone way overboard, and yes 6 cops for a photographer is kind of overkill, and even one or two cops, for something as innocent as that, it really is too much, and what is worse is how the cop lied on the summonse stating how Fred used profanity when he didn't (in NY State, for an official to do that constitutes perjury).

Sigh, and SMFH!!! :-(

Whoa, whoa, whoa now. You definitely have a double standard here. Why isn't there more to this story as there are with other peoples stories? Were you there? How do you know Fred wasn't surly with the cops? You are giving Fred a lot of leeway here that you never gave Nilet and others.

I certainly am being negative with you on this. You posted long ago that Fred, Peter Ehrlich and others never get confronted by the police. I have photographed with Peter several times and we have been stopped more than once. I was with Fred on a Nostalgia Trip / MoD trip and Fred was stopped at Coney Island by the police.

What about the Rail Magazine people at Broad Channel. You never gave them the benefit of the doubt like you just gave Fred. They must have done something wrong?

What if Fred had this hassle with one of your favorite Metro North Cops? Would there then be another side to this story?

I've singled you and Jeff Rosen (Who stated that he would have smashed Nilet's camera if he were still a cop), because you guys never think that the cops do anything wrong. There are others out there too that would never give Nilet the benefit of the doubt, but Fred never does anything wrong.

Are you threatening me with a flood of spam mails? I've heard that you like to do that when people upset you.

I do not know to whom and where you have heard that stupidity/lie from, but I suggest you put that to rest!! I am hardly checking email as it is now, much less sending back email, even more less spam or such idiocy!!

Again, ease back with this unprovoked stupidity. And Fred G, as I stated, has more integrity than most here.

And the Metro-North cops (the "favorites" as you state) have an account of people you guys mention here as same as you guys yourselves comment about. And I never said they do not get confronted, I say I don't because I DON'T!!! Why is that??? I nor anyone will ever know, and contrary to popular belief, I DO NOT carry my ID on my when I am off duty, and the one time I had my ID on me was when I had to head downtown to GCT to conduct some railroad business before I went on duty, and I graciously read the Riot Act to someone who claimed to be an off duty corrections officer when he stated how photography is illegal!! And I never had any issues otherwise, not by NYPD, MTA PD, or any PD regardless of where I been!!

Please present proof where I, at anytime, claimed or stated this!! I have on plenty of occasions shunned officials at any rank for the stupidity of harassing photographers when photography is perfectly legal!!!! The ones who stories I have questioned are people who seem to have problems all the time, and from the accounts of NYPD people I have spoken to along with officers from NJT PD, MTA PD and even Amtrak PD is that railfans are often quick to become very belligerent and hostile when even simply questioned, nothing more.

Are thinking he was surly with them??? Are you thinking he did get hostile with them??? Can you give me a reason why not to give him leeway as much as those here who has posted questionable stories of harrassment???

And at this point, I care not for if there was anything more, as all I care is that when I am out, I have no problems, and I sympathize with those who do have problems, and if ever should one arise, I know how I will conduct myself. From Fred's account....."Let's see a badge" I sez. We all got on the train where he produced a badge. Ok fine, he's a cop. And he continues this tirade where I didn't have authorization to take photos. Jersey Mike heard this and added that that wasn't true. I told the officer to call a cop on us if that's the case.

Let's see a badge, & call a cop on us. If Nilet had said the same thing what would you say? You have a double standard that you refuse to admit.

If the guy didn't readily identify himself as a cop, he is within his right to ask, especially in this day and age of people impersonating cops and committing crimes as a result.

Nilet was confronted by uniformed cops, and ones who identified themselves. Had the person just approached him and not identified himself as a cop and not shown ID, I would not have ever said a word of wrong against that, or anyone who requests the same. Again, in this day and age of official impersonation, and crimes being committed against people as a result, you are, and we all are, within our right to ask.

Again, there is no double standard, and again Fred G has much more integrity here than the people you have mentioned, and as far as the Railfan and Railroad editor issue, I did shun the actions of the officers trying to enforce something that does not exist.

I am no aware of the rules and policies of other government agencies. I know here in New York, both city and state, it is perjury for an officer to falsify any part of a summonse or ticket, be it traffic or any summonse of any offense.

It is not "smart-alecky" to ask for identification, and even ask for, or even call yourself, the police or additional officer(s) to come in order to be sure the person you are talking to is indeed a police officer, in fact law enforcement even encourages people to contact the police if stopped if they are unsure of the person really being an officer, or if possible head to a police precinct. It is not being a smart alec, it is being smart, PERIOD!!! Nowadays, again with the constant crimes being committed by people impersonating officials, it is smart to be sure who you are dealing with actually an official that they state they are.

But in THIS case there's no evidence this person was a rail buff, just someone carrying a camera bag and being harassed for it THIS should be protested by a group demanding a stop to this action, how long before we get padded down for crossing over the GW bridge.

I was not going to say ANYTHING WHATSOEVER but an apology to Fred for having to have to go thru the stupidity of the incident and a trip to court for it, all of it unnecessary and seemingly out of line big time. You are the one who got me involved by bringing my name into this, plus resorting to the tactics of others with unnecessary namecalling and putting words into people's mouths. If I wanted to say that in this thread, I would have. But again, I said nothing and your unnecessary comments and namecalling and snap judgments brought this all to be.

Just let it go, dude. I had no intention of saying your quoted comment I sad from a further back post, or anything other than an apology and to sympathize. Your namecalling was and is uncalled for, and you could have saved the commentary for IF I chose to state same or such.

Of course Fred is not guilty, that was the whole point. Neither was Nilet which was the other point. You and so many others here have vilified Nilet in the past and have now given Fred the benefit of the doubt. I am just bringing up the double standard that I see.

BTW Fred is a much better person than he is a photographer. Yes, I have met him.

Because many people live paycheck to paycheck - jury duty pay does not cover rent and mortgage payments.

My dad depended heavily on tip income at the time - even if his job continued his base pay it would not have been sufficient to pay the bills.

I know I should never lump in all of Philly. As a matter of fact (I live in Allentown, not too far from Philly) with the current Mayor Nutter running the place, I think this is the best I've se of the city in years. The hsitory of Philly parallels that of my own home town, the South Bronx. The city has lost businesses, manufacturing companies and population. There are many neighborhoods that are abandoned, just look near Temple U's campus from SEPTA's line there. Anyway, I just wish SEPTA was a better transit partner with it's own city and with the surrounding area. They need more clout to get more funds from where ever they can. They also need to kick Hyundai Rotem in the ass and start charging them for being late.

Certain people have reputations and the way in which they conduct themselves suggests that they agitate the cops and make matters worse for themselves.

But my point also is that the fact that a cop tells someone to stop taking pictures or that photography is not permitted in and of itself is unacceptable. The very fact that a cop interferes with photography is offensive even if the photographer politely obeys and leaves and no further confrontation occurs.

Given the new Pennsylvanian governor will not be pro-transit, and not the least bit sympathetic with SEPTIC's management, he should be made aware of their ineptitude as well. The only thing they will wake up to is a whack to the operatring subsidies as a direct result of wasting operating money and time on these Keystone cop shenanigans.

Really? That's very interesting. Even right before 9/11 (and I mean just about RIGHT BEFORE - it was during the transit festival at Hoboken that year) I was taking pictures (or trying to anyway, dead batteries) in PATH, indiscriminately, without any hassle. A couple of the employees even waved!

And all you get in return is the stupid "9-11 form letter" that tries to justify the cop's actions. "In these times...bullshit..bullshit..and more bullshit..."

OTOH confrontations that led to arrests have led to court orders and consent agreements against police departments. Photographers who play nice have lost valuable photo shoot opportunities but those who fight back have won real money and guarantees!

Railfans are not the only ones being harassed. Just look at what happened to the Daily News reporter who tried to file a report about yesterday's airport delays. He went to file a complaint with the Port Authority and was told that they would confiscate his press credentials if he complained. The Daily News and the National Press Photographers Association are FUMING mad and are going to go to court over this!

Haha. I actually charmed my way into taking some PCC pictures at Grove St in Newark one day by smiling at a female NJT worker and chatting her up. She probably had poor eyesight now that I think of it. LOL
