I totally believe Fred, and all along I have. I was just saying why the idiot didn't give him a ticket for a law that doesnt exist (photography), and why he probably put that lie of profanity in the ticket he did give. From what it sounds like, the guy really had a chip on his shoulder, especially if he actually said "that will teach you how to treat an officer when he questions you". That shows an extreme arrogance on his part.

What does PATH have to do with Philadelphia? SEPTA and PATCO don't have official policies prohibiting photography.

I'm sorry to learn that you aren't interested in seeing anything Philadelphia has to offer, but what makes Philly worse than other cities in the case of transit photography? There are countless stories of such instances in New York and other cities....

There are signs are all the MTA Toll Bridges stating the photography and videos are illegal. Of coursde, what is stopping you from taking pictures or videos from the street of the bridge.

Fred, I think this anal cop had nothing else better to do during the day but to harass you. Cops tend to give out more ridiculous tickets towards the end of the month to satisfy their QUOTAS that they are asked to write from their Commanding Officers. They should be worried about more important issues such as crime and stuffing their faces with donuts and coffee.
However, from this cop's point of view, (even though I think what the cop did is bullfunky), he probably thought you were impeding passenger and subway traffic when you were taking the pictures. The reason why he gave you the ticket was to fill his quota and he wanted to get you for something even though you stated that you did not use any profanity.
I'd definitely report your situation to SEPTA, ACLU, and the Press. I hope that you got their names and badge numbers, time it happened, location and whatnot. Make it known that these idiots shall not overpower their authority to bully us around.
I'm sorry that you and Jersey Mike had to go through this. The more the authorities do this to us, the more our liberties and freedoms are being threatened and the more the ones that do not have the same liberties and freedoms as we do, the more they are winning.

In reality taking pictures is NOT illegal. The law states that pedestrians and motorists must obey all posted signs. The MTA cops used to cite photographers with "failure to obey a sign". Citing them for "obstructing governmental administration" appears to be a new tactic and an escalation of their War Against Photography.

As for whether or not the MTA has the legal right to enforce such a ban is just begging for a challenge by the NYCLU and if they are escalating the charges then it will be worth the effort of someone to challenge them and kick some constitutional sense into the MTA's butt!

HOWEVER the photographer in question was NOT taking pictures - he was harassed merely for POSSESSION of a Camera. Is the MTA's position that you cannot use the walkway if you are carrying a camera for use at your destination across the bridge?

I used to back the police but the way they have treated photographers has caused me to lose virtually all respect for police and on a higher level increased my distrust of government exponentially. These cops are not acting on their own - they have at the very least tacit approval from their superiors and the leadership of their city's government. One cop acting alone could be a rogue cop but 6 are a conspiracy!

The way I see it is that photography is legal so there is no "other side". The minute a cop says "photography is illegal" - he is wrong and there is nothing further to discuss. However if the photographer is trespassing on non-public space (ie. the trackbed) to get the pics then that is a different story....

Hey Fred,

Wanted to meet up with you guys yesterday, but didn't get to Philly in time to meet you (got to Market East about 11:15 AM) so I had no idea where you were.

I did my own railfanning instead:
MFL from 8th to 30th
Rt 11 to Island Av then back to 30th
MFL to 69th St Terminal then lunch at Popeyes on 69th St. Then MFL back to Girard.
Rt 15 to Westmoreland Loop then back to Girard and Broad
BSS to 8th
R8 to Wayne Junction (got a lot of (night) action at this stop) then a train back to Market East where I got the R7 back to TTC
NJT to NYP and back to my grandmother's place via the subway to the Bronx where I posted this message from.

Pics to be posted shortly (within a few days once I get back home in NJ).

I plan on meeting you guys for the official SEPTA trip, but not at the beginning. If worse comes to worse, I'll meet you at City Hall when you go to lunch.

Fred, what happened to you is total crap. There was no need for the cops to do what they did. Let's hope that the citation you received gets dismissed. If anything, the cops need to be re[rimanded for not doing their job properly (if they were doing their job properly, 6 cops wouldn't have been there in the first place and the cop that stopped you should have gone on about his business once he saw that you weren't a threat to anyone).

Yes I agree. In 99% of the time u would b 100% right but it is also how 1 deals with the cop that sometimes gives the other side. Not talking about this case at all tho here the cops were 1000% wrong (I meant the 1000)

Fred, this is a terrible thing to have happened and I'm embarrassed that it happened on my home system of SEPTA. The pictures you took of the system before were remarkable, and I hope this doesn't deter you from visiting ever again.

I also hope that you bring this to SEPTA and the ACLU as others have suggested. This type of thing really hasn't come up much in this area, and needs to be brought to light. SEPTA has publicly announced that it has a "customer service" focus, and they really are serious about it. Writing a formal complaint should bring action or at least grab someone's attention.

This type of nonsense needs to stop. Sadly, this was a nice reflection of the attitude I've seen with the Philly PD and the SEPTA Transit Police over time...

Yeah, I am wondering about the whole 4-6 cops being there. That's quite outrageous...there are other things they need to worry about...and you shouldn't need so much "back-up" even if Fred was doing something "against policy".

When I was a platform C/R at Canal St BMT, an NYCTA cop mentioned that he had a problem with a Chinese fare beat who played the "No speak English" routine. The cop said well in that case I have to bring you to the precinct where there is an interpreter available. The Asian perp seemed to develop a rather quick command of the English language when he heard that.

Well, BMTLines I think it depends on the person TBH, but in this case I totally think what happened is true and is the whole story as Fred has a very good rep and is always pretty reasonable. Those cops were ridiculous (?sp) and all should be disciplined.

Exactly. Certain people have reputations and the way in which they conduct themselves suggests that they agitate the cops and make matters worse for themselves. I've met Fred, he doesn't seem like one to do that, and the fact there was an eyewitness (which we rarely get in these situations it seems) who is giving the same story makes it even more credible.

You are assuming the "official" in question can read English & I'll elaborate:

Although I had "No Parking" signs clearly displayed on my garage doors at my apartmrnt building when I lived in Reading, & still had people parking in front of my garage. When I questioned the police on this the response was that I assumed the sign could be understood. Kinda like the Chinese answer in reverse. Anyway I don't really think that is what is going on here since SEPTA's website has 14 languages in addition to English.

I got hassled at Philly's Arrott Terminal last year, while they were power washing it. A worker lady gave me a hard time about taking her photo. She called it in on her cell phone, whoops, I thought that was a no-no for SEPTA employees?

Too bad the schools were off this week. This would have been an embarrising PR problem for SEPTA police, while they were harassing photographers, the low-class animals of the Philly School District were creating mayhem at the 15th St platform on a daily basis. The Philly news media would eat this up like a greasy cheesesteak!

Sorry to hear about that, Fred!!!

Too many paranoid, clueless personnel who either don't read notices or don't care about notices!! There are a few crew persons and engineers here I had to put in the know about photography NOT being illegal on MNR property, as there are a few who thought it was.

Fred G's integrity is not questionable, as others' integrity are. And based on the attitudes of some here, it is reasonable why they would be in trouble with the police because they let their mouths rule their good judgment and sense!! Fred remained respectful, had a witness to everything plus the officer was even more out of line when he, basically, committed perjury by stating Fred G was using profanity when he wasn't. And I never claimed to love the police, as I admit and have admitted when certain officials are clearly out of line, as this one was.

Easy on the name calling, bro, I never said no insults or name calls your way!!! Don't make this something negative, because if so choose, you will be dealt with as others have, and you might not like what comes of it!!!

It is funny how just yesterday I was discussing how photographers get harassed for what I and others here love to do with my wife, and we were talking about how the police never seem to be around to catch real crime, like the 17 year old who was shot and killed Christmas night on the platform at East Tremont Avenue on the 2/5, and the killer vanishes without a trace, or cannot seem to stop the rash of car breaking in my neighborhood perpetrated by knuckleheads who come up from the South Bronx looking for nice cars to hit in the nice areas, yet they harass those "every so dangerous to the safety of the world" photographers every second and at every which place they can, and do so in numbers, as this case with Fred G illustrates!!

Sigh........
