Anybody can be arrested on any charge. That being said I doubt the Prosecution can ever prove beyond a reasonable doubt that he was guilty of Murder. The cement is a potentially dangerous weapon and the police cannot just take the kid's word that he is unarmed. If the officer lowers his weapon it does not take long for the kid to whip out a concealed weapon and kill the police officer
