1) That kid was no choir boy
2) According to Missouri's self-defense statute plus the fact that the officer always has more leeway when a suspect is resisting arrest I do not think there is enough there for Murder
3) That the kid was unarmed was irrelevant if the officer had no unbiased confirmation (for example another officer having searched the kid and finding none) that the kid was unarmed. The officer cannot take the kid at his word that he has no weapons on him. Not to mention the pavement can kill people
