To finish my thought:

So you can see that the MTA is sending mixed signals (no pun intended) to amateur photographers. It should be noted that in Nilet's case they did not cite him for "photography without a permit" but rather trespassing. I am not an attorney but I would presume that since the "rules" are arbitrary and not supported by any legislation they could not serve as the basis for an arrest or summons. OTOH if he was in fact on a platform not otherwise open to the public then he would be trespassing. Then the question is - were there signs posted that said "No access beyond this point" or something to that effect or are we supposed to be mind readers?
