I agree, which is why I do not advocate photography from restricted areas. I do advocate photography from those areas where one is legally permitted to be at a given point in time.

The offense in question is then "trespassing" rather than "unauthorized photography". The dispute with the MTA is whether or not people who otherwise are in a location legally can take pictures of anything they see from that location. My argument at that point is that they should be. The MTA officially seems to be making trespassing the issue, while it's employees and police on the ground are making it a photography issue.

Based upon the information available here the employees who first encountered Nilet did not tell him that he needed to leave a restricted area - they told him that he could not take pictures - the implication being that he could stay and look at the train. There really needs to be clarification or there will be more and more incidents like this.
