These are good points, but let's be sure we're not conflating the issues here. Even if we assume that the trespassing charge itself is valid (I don't know enough about the applicable rules to determine whether it was at this point), it still doesn't excuse the police taking the battery and memory card from the camera. Even if Nilet was wrong in being there in the first place, there's still a possibility that there was also wrongdoing on the part of the police.
