employees are only as good as the quality of the training they receive and any SOLUTION involves "improving" that training. Let's PRAY that this makes its way down to those in the trains ... :)

And the vast majority of employees don't act like this T/O did. So how is this a training issue again? Does everyone who took the training class with her act like this, or is it just her? There's your answer.

I don't have the memo

I havent seen anything "updated" in a while,(and i read that bulletin board every day when i report to work) since the first "notice" came out..

I will look for it tomm and see if i can "clarify" a few things..

IF i can find it...

As for all the other drama that i see posted, all i can say is it could have been handled better by "Both" Parites invovled perhaps?

It should be just left at that really....

The MTA is fully aware of how its employees are treating photographers and while adopting an "official" line that photography is legal it has given tacit approval to its employees to enforce an "unofficial" ban.

I dont recall no such notice, memo or bulletin saying that..

I said "tacit" approval, meaning non-verbal or implicit. If the MTA were seriously concerned about complying with the photography rules it would have issued memos once it became known to them that employees are in fact stopping legal photography of the system. Both the NYPD and the MTA are taking advantage of the current situation - they get to get to put on a nice public face and say that there are no photography bans while at the same time allowing employees and officers to enforce a "back door" ban.

This is why I feel that lawsuits should be filed each and every time a photographer is told he cannot take a picture - hit them in the pocket where it hurts - make the NYPD and MTA bleed money till the harassment stops!

It is what I consider approval by inaction rather than by action. The MTA and the NYPD are fully aware what their employees are doing. The NYCLU, NPPA, Pictureny.Org, and various photo clubs have written letters and filed complaints. The fact that they have not issued a clarification of the rules to their employees means that they are allowing, if not encouraging harassment of photographers.

That's not the point I am trying to make. It is fine that you know the rules and your dispatchers, etc. know them too. However many employees don't and despite letters from the NYCLU and other organizations the MTA has done NOTHING to address that situation. It is happening too many times to too many photographers to be an isolated incident (just look at Flickr and the other photo boards). Same issue with the NYPD.

It's like some bill collectors that I used to work with many years ago. If a customer complained management would apologize for their behavior and smooth talk the customer in question. Meanwhile allowing the collector and others to continue harassing those who did not complain. The OFFICIAL memos and work rules said one thing but what the company tolerated and encouraged was something else entirely. All done with winks, nods and pats on the back - NO MEMOS!!

If the MTA is serious about resolving this issue then it should issue a clear and unambiguous memo to all employees reiterating that photography is legal. OTOH I doubt that they will ever do that unless forced to by court order.

1) I don't know what memo Brian is referring to or how he managed to get hold of this alleged memo.
2) I cannot find any official mention of the alleged incident that Nilet is referring to.

All that having been said, I am finding this entire thread to be quote revealing of the mentality of the typical foamer.

The NYCT as all other rail transit properties is in business to transport customers from point A to point B as rapidly, cheaply and safely as possible. This is done with varying degrees of success but usually getting a passing grade. They are not in business to provide subject matter for hobbyists or photographers. To the extent that they bend to accommodate the hobbyist aand photographer while carrying out their primary mission, they do a fair balancing act - as evidenced by "open houses", "rail-fan trips" and general accommodation of the participants. However, based on this thread, it's clear that the attitude of most of the participants is "Damn the legitimate concerns of the properties and the customers, since all that is important is "OUR RIGHT TO TAKE PICTURES".

Those such as Nilet, whineburg and most others here who "Demand" their rights over those legitimate concerns damage the relationship between the operating agency and the hobbyist. Those who profess to know what those legimate concerns for security should be, colored by their own selfish motives, only engage in sub-intellectual masturbation for their own amusement. What everyone seems to forget is that the NYCT according to that same often-quoted pamphlet, IIRC, can unilaterally change the rules about on-system photography or ban it altogether at their discretion. Other properties have already done so. What i do not understand (and I speak only as acitizen andhobbyist here) is why those such as weenieburg and nilet want to continue to provoke such a response by their lack of flexibility and accommodation for the agency's legitimate concerns.

If they could change the rules unilaterally then there was no reason for them to have public hearings when the photography rule change was proposed in 2004. It isn't that easy. Meanwhile other properties are actually liberalizing the rules with the exception of PATH. NJ Transit dropped its permit requirement, Boston no longer requires a permit, LA promulgated new rules allowing non commercial photography....

NYCRR stands for New York Code Rules and Regulations The process for amending those rules is shown at that site. As you can see it isn't as simple as declaring photography banned.

If NYCT decides to ban photography then the constitutional issue comes into play which the NYCLU will fight. They will also have to contend with groups like PICTURENY.ORG which was instrumental in blocking passage of the initial MOFTB street photography regulations.

There are just too many stories on this site, Flickr, PictureNY, Photopermit.org and others relaying stories of photographer harassment both by the NYPD and the MTA. Too many people are being told that photography in the subway is illegal. Therein lies the problem. That is why I found Nilet's account to be plausible. If these stories did not exist and Nilet's experience was truly unique then I would have given the benefit of the doubt to the MTA. But I have witnessed cops telling tourists on the subway not to take pictures. They were not blocking anyone's passage or in any way interfering with operations.

If safety were the concern then the cop/employee should say something like - "you can't stand here but it is ok to stand in the middle of the platform". But that is not what they say - they say photography is prohibited systemwide and at all times - period. That's the problem!!!

The LACMTA photography rules are proposed and not yet promulgated.

And I agree that Nilet's story is plausible. And it's not just limited to subways or NYC. As you've pointed out it's become a problem a problem for photographers all over the country.

The Memo was in March of 2007 B Div stand down notice. I signed for it TWICE!! It one of those things thats say Picture taken is legal but it suspicus based on what kind of pictures taken. Its not a bulletin its a memo which has the same effect as the book of rules. However I love the last line as if it was a Bulletin "Line Managers / TSS will strictly enforce". The F Line was also pushing this in Feb 07 then the stand down notice came out with this included which means I signed for this as well but this was a F Line directive.
All I keeped thinking about is TSS XXXX going to take a picture of me entering 179 on my next trip to see if I get on the radio???

Each is entitled to their own opinion and stance and POV, no matter how hard you tug you're not gonna get the fight out of the dog when the dog has got as much a bite as he's got a fight in him.

I've had nothing but pleasantries meeting and conversing with TS and I would hope to have much the same with MOO if/when we do meet!

Screw it if that makes me a 'fanboy'..... fact is fact.....
you're still nibbling at old issues you said were passe.

I'd much rather see you shed insight and fundamental experiences in transit..... that's your strengths..... and your airchecks!

Ah! it was that "notice" i was in the A Div then, i wont find that notice anywhere then beacuse notices like that arent "posted" on the bulletin boards..

If thats the case i dont see how Terrapin "seen" that notice since only Hourlies eyes have seen it..

Its a "safety stand down" if you dont work down here you dont see it, unless somebody "gave" it to him..

Dude...fergit da ka-nuclehead. "Official" is one thing, "reality" is something else. You know, I know, all G*ds chillins know...mostly. The chips will fall as they may. N one day, as a line gets crossed, as "but i'm OFFICIALLY right!!" gets shoved into the appropriate locations...perhaps, I say, perhaps, a lesson will finally be learnt. The one about sand in the gears...
