That's not the point I am trying to make. It is fine that you know the rules and your dispatchers, etc. know them too. However many employees don't and despite letters from the NYCLU and other organizations the MTA has done NOTHING to address that situation. It is happening too many times to too many photographers to be an isolated incident (just look at Flickr and the other photo boards). Same issue with the NYPD.

It's like some bill collectors that I used to work with many years ago. If a customer complained management would apologize for their behavior and smooth talk the customer in question. Meanwhile allowing the collector and others to continue harassing those who did not complain. The OFFICIAL memos and work rules said one thing but what the company tolerated and encouraged was something else entirely. All done with winks, nods and pats on the back - NO MEMOS!!

If the MTA is serious about resolving this issue then it should issue a clear and unambiguous memo to all employees reiterating that photography is legal. OTOH I doubt that they will ever do that unless forced to by court order.
