The death benefit is negotiated. I strongly doubt that they can unilaterally take it off the table. While I agree that people should be vaccinated, this does sound like over-reach that would likely be struck down in a court challenge.

NOTE: I suspect that the "chief people officer" is the woke title for the head of "human resources". Human resources sounds so cold and impersonal.

What I was trying to say was that, if you negotiate Death Benefits, you may not have a say in who gets what. One of the criteria for awarding injury or death benefits is past practice. COVID is a relatively new factor

It is also possible to negotiate a separate "side agreement" the terms of which do not become permanently part of a CBA, and that is not uncommon in dealing with major issues that are considered likely to be temporary. It definitely has bearing on the likelihood of any possible litigation being successful.

While I support the MTA putting strong pressure on its employees to get vaccinated, I don't support yanking life insurance coverage.

The "moral hazard" life insurance provisions become a slippery slope. Where do you draw the line? Should employees lose their life insurance if they die in a mountain climbing accident? Because they smoked? Because they had a motorboat accident?

They call them Human Capital offices in places now.

The issue is, there are many levels of things that need to be do to contain and stop the virus. NY's MTA is probably last on the list of doing almost anything, unless this has changed in the last 9 months since last years dismal performance.
Now we want to go straight to vaccinations as being the end all be all, but it takes a lot of measures. The US is being lazy.

If it's a multi-million dollar policy on a key employee, I agree that a hazardous conduct clause is fair game. For a broad-based policy, it should be restricted to the commission of a felony or suicide for a certain mumber of years after the start of coverage.

Life insurance is a terrible way to try to enforce good behavior. Higher premiums for smoking, or similar things, are less drastic approaches.

I agree with your slippery slope worries but in this case it is a preventable death by just getting vaccinated . If you die unvaccinated you should not get paid out.

The same is true if you die of lung cancer and you are a smoker. It is a direct cause and effect

It is a direct cause and effect

1. It's impossible to draw a clear line.

2. It's open to abuse by the entity paying the benefit. You'd end up getting fly-by-night life insurers who have so many fine print exceptions that almost no one benefits.

3. It penalizes the survivors, not the reckless individual. At least health insurance surcharges penalize the individual.

So, by your logic, a speeder who gets killed in a car accident shouldn't get paid the value of his life insurance policy? That whole concept of not paying off the value of a life insurance policy because the insured had a hand in his/her demise is pure nonsense. Try telling that to the cleanup workers at ground zero who willingly took part in clearing out rubble amid all those toxins while finding bodies, and paid with their lives. You're not going to pay them?? I don't think so.

The $500,000 death benefit was payable to the families of transit workers who died after a COVID infection. It did not require proof that the worker got infected as a direct result of their job. In the beginning of the COVID epidemic here, transit workers were exposed to the general public and were not provided with much protection by the MTA. This special benefit was a sign that the MTA recognized the risk that workers were taking by remaining on the job. Now we have several vaccines that reduce the risk of hospitalization and death to a very low value. A worker who is fully vaccinated and gets COVID and dies should continue to get this benefit. A worker who chooses not to get vaccinated and gets sick and dies could be said to have contributed to his demise. It's not mean spirited of the MTA to disqualify that worker's family from receiving the special $500,000 benefit.

I believe commercial life insurance can only exclude suicide for 2 years.

Ah, if it's a special amount in excess of the standard life insurance, then it makes more sense to exclude the unvaccinated. They should still be eligible for the same life insurance benefit as for any other cause of death.

AFAIK they do nowadays since suicide is considered an extreme symptom of mental illness, Survival is a basic need as Darwin outlined. When you don't want to survive, thats an example of a flawed mental process. In plain english, you're sick in the head if you want to kill yourself. Thus sick people get their life insurance $$$ to those named on the policy.

Why? If you're being asked to go into a dangerous situation, then additional pay is warranted. If you are offered protection that will remove over 90% of the danger and refuse it, then why should you be entitled to the extra pay?

I understand that you don't like vaccine mandates, but they've been around for decades. The MTA agreed to the additional death benefit when there was no reasonable way to provide protection - but now that there is, revoking the benefit for those who refuse to protect themselves is not unreasonable.

I am hardly an HR expert but as a layman:
A provision of the CBA provides that in the event of a job related death, the estate of the employee is to be paid a defined amount. It would seem that at some point. Covid was presumed to be job related because of the conditions under which employees had to work. The unilateral termination of that benefit would seem to be a breech of contract since the vaccination was not a consideration when the cba was signed. Any changes would need to be negotiated.

OK, thanks - but my understanding is that the extra $500K death benefit was only a temporary benefit, which was not part of the base CBA and had an expiration date. It was renewed once, and what the MTA is now saying is that now that it's set to expire again, they'll only renew it as a benefit going forward for those who are vaccinated.

I could be wrong on the facts, but if they are as I described, then the MTA would be within it's rights to not renew this benefit at all - or to renew it with new limitations, such as requiring full vaccination, in order to be eligible. I do absolutely agree, though, that if this was part of the CBA and there had been no condition attached, the MTA would have no right to unilaterally impose a new vaccination requirement.

Of course I have been gone for more than a decade and it could be something newly added to the CBA but it would still would have been negotiated. Nothing gets given for nothing.

OK, thanks. I'd thought this was either a temporary addition to the CBA with a defined expiration date, or an MTA throw-in to encourage workers to come in, also with an expiration date. Now that the expiration date has arrived, the provision can be changed - by negotiation if part of the CBA, but unilaterally if this was an additional benefit that the MTA had provided on its own - without it ever having been in the CBA.

In any case - I think it pretty likely this will end up in court.
