You seem to think they should get away with it then,if you "don't really care". One case like this,one ruined life is more than enough. If it gets to be a trend a DA notices, it's time for new legislation and increased penalties sufficient to put a stop to it.

Why? That has nothing to do with the issue. Others here agree that should be serious penalties on landlords pulling this stunt. Even some landlords themselves.

i am pointing to an identical situation and seeing if you feel the same way about other victims of false accusations; and you refuse to answer the question. i'm sure there are more false reports of domestic violence than there are cases of landlords filing false reports against their tenants.

Sometimes the law isn't clear, or the available legal remedies don't completely address the issue. In these times of obsessive background checking, a wrongful eviction can render a tenant jobless and homeless. There must be penalties sufficient to ensure they are made whole. Is what's on the books enough,or do new penalties need to be developed?

I'm no lawyer,nor do I know of any precedent.

The article doesn't make any sense.

It says that landlords are using this tactic to avoid endless eviction cases in court when in fact such a tactic would insure even LONGER and MORE EXPENSIVE court cases and possibly criminal and civil liability for false statements and accusations.

Landlords and building owners don't want to lose good tenants.

A good tenant losing his/her job can be just as hard on the landlord as on the tenant.

Landlords don't want to lose a good tenant but they shouldn't be asked to lose money on their investment either.

It sounds like an urban legend to me.

If the intention of the landlord is to cut the times and court costs of going through the legal eviction process, this tactic assures the OPPOSITE!!

Only a complete idiot landlord or property owner would be stupid enough to try to pull such a stunt and think it will save him money.

This must be one of those things that may have happened just once or twice but people with an agenda will call it a "new trend".

What do you mean by an "uptick" -- from once last year to twice this year, or something more meaningful?

Realistically, I'd think it would be a fairly easy road to home ownership for the displaced tenant -- it would be fairly easy to show damages in a civil suit against the landlord -- and a good way for a landlord to lose their asset.

No, in fact it seems like it's totally made up, and a "good story" in search of facts. If you scan for "Deja vu" in the title, he made the same sort of wild story about a landlord (well the claim is that it's widespread of course) doing this back in January too, with the exact same crazy scenario, except that time it was the tenant "storing guns" in the apartment instead of assault.

What I could see happening is landlords calling the police about minor crimes that the tenant is committing; IE: the landlord knows the tenant is pot smoker calling the police about drug use.

But this time, the gentleman in the Queens DA's office brought this up in our discussion, not me...and it has been a recurring theme in neighborhoods like mine. I've heard variations on this theme over the past few years.

There's absolutely nothing to back this claim up. Again, it probably has happened in some isolated incidents, but there is absolutely no evidence this is some huge problem.

I haven't, as I noted earlier, finished looking into this. But I think, given the history of shenanigans involving NYC landlords--and you're right, not all of them are "evil"--that these reports are at least plausible...and thought it interesting enough to post here.

Sounds too simple. The cops are going to arrest people just on someone's whim with no evidence of an assault? Doubtful.

The guy who used to live next door to me got scammed by tenants in his 2-family house. They paid the first month's rent then stopped paying after that. Took him 6 months to get rid of them because they had 2 small kids. The scammers moved out to Brooklyn, then a few months later, moved back to S.I. where they pulled the same scam.

I used to think that 2-family homes were exempt from a lot of the tenant protection laws because they are not multiple dwellings, I guess not.

They are. It's way harder to get someone out of a 6+ unit building.

2-5 family you can always get them out eventually - they have no right to a renewal lease. 6+-family, if they are rent stabilized and pay their rent you'll never get them out unless they provably have destroyed the place.

What is the end result here....if a person calls 911 knowing fully that he/she is placing a FALSE 911 call which ultimately means the caller is risking being arrested for a false emergency call.

Exactly. As was pointed out, there's no evidence for this. Perhaps it happened in an isolated couple of incidences, anything is possible. But we went through this same song and dance back in January with the same scenario, only then the tenant was "storing guns" instead of "assault" being the attribute instead. I still call bluff, it's a great story looking for facts.

That was relatively quick to get them out in 6 months. As you said, the laws are worse for multi-family dwellings. I believe 5+ they kick in. If it was a multi-family dwelling, it would have taken even longer, especially if the tenant knows how to work the system.

The scammers were real characters but otherwise quiet people. Husband, wife, teenage daughter, smaller son and daughter. A month later hubby moves out, mommy gets boyfriend who was very friendly with teenage daughter, at first I thought he was her boyfriend.

A few months later they finally are moving out. Hubby AND boyfriend show up to help on moving day. Who says family values are dead. As they are driving away, without their son, he is running down the blocking yelling "wait for me" they scooped him up and drove off into the sunset.

Somehow, based on the way he posts, I doubt he meant the more accurate 6 months, as opposed to the absurd 6 weeks, as that would make deadbeat tenants look bad.

He says 6 weeks from service to eviction. I think he means service of an eviction order, not service of an original order to appear in housing court to contest charges of non-payment.

????? An eviction is the entire process. A landlord will be out at LEAST 6 months of rent, and that's if the tenant doesn't know how to play the process. To even try and hint that the process will take 6 weeks is absurd, and that's exactly what he tried to say.

Again, someone puts out false skewed information, and someone has to try and say "what he really meant". JZ knows THAT we meant the eviction process from first filing to the landlord getting the apartment back, and that will be a minimum of 6 months without rent, and that's if the landlord is lucky.
