Yep ... and fact is, if you CLEAR it ahead of time, you can STILL get a cab ride ... did a CPRail trip with a buddy just three weeks ago between here and Mechanicville, and when he was done the taxi to take him back here took all three of us back here after he went dead on hours.

It's ALL about "being known" as "non-toxic." :)

Even in the early 90's, there were signs saying you "can't take photos" at Newark Penn. I did often back then, but no one ever bothered you. Ihave no idea what it's like now, as I haven't done it in years.
As for NY Penn, even in the early and mid 90s they would tell you you can't take photos or be on the platforms unless you have a ticket. I understand what you are saying, all I am saying though is that this is nothing new.

For a second, look at it from MTA's perspective ... if ANY asshole can go onto an unattended platform, they could also plant a BOMB before they go clicky-clicky ... as I've OFTEN said, admittance to "restricted areas" is usually a simple matter of letting them know AHEAD of time what you want, and if it doesn't distract observers from OTHER duties, and you don't mind an escort, someone will make SURE you don't plant a bomb while you snap away ... done it ALL the time and gotten some real treats over the years ... it's when you SURPRISE them by going out there without warning, and then do something stupid that bad things happen.

the open question is whether or not a photographer can take a picture if he is in the process of boarding or leaving a train, thereby placing him on the platform legally.

That question is not open. The memo from the police chief supersedes the MNCR email response.

Well, those are the supposed signs. They may not be actual "rules". In other words, if you violate the sign, maybe they can ask you to leave. And if you don't leave, then they can charge you with trespassing.

I agree, which is why I do not advocate photography from restricted areas. I do advocate photography from those areas where one is legally permitted to be at a given point in time.

The offense in question is then "trespassing" rather than "unauthorized photography". The dispute with the MTA is whether or not people who otherwise are in a location legally can take pictures of anything they see from that location. My argument at that point is that they should be. The MTA officially seems to be making trespassing the issue, while it's employees and police on the ground are making it a photography issue.

Based upon the information available here the employees who first encountered Nilet did not tell him that he needed to leave a restricted area - they told him that he could not take pictures - the implication being that he could stay and look at the train. There really needs to be clarification or there will be more and more incidents like this.

Photo Flashes are directed and focused at the train in question.
A Track Flash is not directed, is not focused at the train, and is off-view to the T/O in question in most instances. They do not occur directly in front of an operator trying to stop his train in the station.

Heh. Funny story ... growing up int eh city and all, got trapped in more than enough Otis', Millars, and Westinghouses. Learned to observe what a mechanic did inside the panel, where the "override" switches were, as well as the mechanics of "door release" and "sensors" ...

When I worked in Smallbany for the state (Otis, but Millar maintenance) elevators would often break down, and I HAD the equivalent of a church key on my chain (arnine key) and when the elevators died, could open the doors and kick them into "computer bypass/manual/fire key" mode and get the dead elevator to a floor and open the door when I was on it so folks could at least get off.

When I worked for the NYS Commission on Cable TV as well as Department of Public Service in another building, became known as "Patron saint of the elevator." People who would otherwise take the stairs would BOARD a car as long as I was in it. Heh.

NOBODY went down the shaft with ME in the car. =)

Where did he not comply? He wrote that he asked what would happen if it he didn't turn it off (which is a valid question, because as you note, they had no right to ask him to turn it off). There's nothing wrong with simply asking a question. That should not escalate anything, unless the officer is not being professional. Thus the officer's unprofessionalism in responding to a question is what further escalated it, IMO.

When I once asked a policeman what would happen if I continued taking photos, he did not grab my camera. He simply told me his answer.

Again, I haven't done enough research into this to say anything definitive, but in theory they can post signs all they want. And those signs could say whatever. But unless there is some underlying, valid statute that allows them to prohibit photography in that area, your First Amendment rights should trump whatever policy they think they can enforce. In other words, just because they put up a sign doesn't mean that they can constitutionally enforce it.

I've personally witnessed the conduct of a small number of these "victims" and they're lucky that "harassment" was as far as it went. They're not even willing to "travel in simple pairs" in order to back each other up by providing "witness" on the behalf of one another in the event of one being accosted. :(

In part that may be because of the autism or Asperger's aspect: This is, for some, a solitary activity. They cannot cooperate with one another and cannot cooperate with police or communicate appropriately because they are cognitively disabled.

I wisjh the police would take that into consideration.
