Just so you know where I'm *personally* coming from, as I've expressed here from time to time ... I come from a family with a large number of ex-military and police. So I know EXACTLY how to deal with any such situations - rule number one - demonstrate by your actions that you are not a physical threat, then be reasonable and attentive and respectful - THEN assert your innocence once the priors have been satisfied. Cops unfortunately require some time to "measure you up" from a threat status, then determine that you're capable of being reasonable. Once all of THAT is established, your chances of asserting your rights are multiplied exponentially.

Once your "threat status" becomes benign, you're more often greeted with "OK, do your thing and get out of here before they make me come back and waste my time again." At NO time do you need to surrender your rights if they're lawful ... but COMMUNICATION is everything and as we all know, cops ARE given "discretion." At the end of the course you're currently engaged in, it would probably be helpful in the final "recommendations to subway photographers" that something along these lines in keeping with CLU's policies become part of the "final advice" which will eventually be issued.

Sadly, there's a lot of small minds out there who are ready to sue everybody first and ask questions later and wonder why they got hosed, beaten and sent home after being laughed out of court. Legal advice is a wonderful thing and I have faith in you guys getting the DEFINITIVE document as an end result. However I'd also suggest "don't be stupid." As the Black Panthers once said, "KNOW the law, KNOW yourself." :)
