Why wouldn't this be within his knowledge?They apparently had testimony that the train increased its speed approaching the crossing and that the engineer chose the horn over the brakes. The real problem is that people stopped on railroad crossings should be held strictly liable for all damages caused by such, unless some fault is found with the warning system. |
