I didn't say there would have been a different outcome, just that we don't know if there might have been a different outcome.A civil jury found the MTA negligent, primarily because of the engineer's conduct and the design of the third rail. So implicitly they found the engineer negligent, whether rightly or wrongly. He was never found criminally negligent. That would have required a far greater standard of proof of recklessness than just "in the opinion of an expert witness, had he acted differently there might have been a different outcome." |
