They can make cops retire at 63 they can make school bus drivers retire at whatever age they come up with.

The lack of a mandatory driving retirement age is totally politically driven. No politician is willing to pry the car keys from a senior who has no business driving whether it’s a car or a school bus. This guy allowed his cdl to be suspended 14 times. I don’t care if they were parking tickets. I drove for NJT for 17 years and I protected my cdl status like it was my next breath. His suspensions screamed of callous disregard for the law. It’s the politicians in Trenton who have blood on their hands. Oh yeah, they’re too busy passing the thoughts and prayers

If someone was 55 with that driving record would that be different?

Does NJ have a regulation comparable to NYS 19-A, and if it doesn't why not?

Mr. Muldrows crime is not that he is 77 years old. His driving record (license suspensions, speeding violations etc. is an indictment of the laxity that is coming out of Trenton. In my world he would never qualify for a cdl whether he was 77 or 27. My point is that a reasonable, blanket, mandatory retirement age for cdl holders in general and for school bus drivers in particular would fill in the gaps that Mr. Muldrow was able to take advantage of. Would some good drivers suffer..yes. Would other drivers like Mr. Muldrow finally get pulled off the road..absolutely. It’s your life, or your kids life, or your grandchildren’s lives. All aboard!

The one thing I haven't seen mentioned in any of the media coverage is how long Muldrow was employed by Paramus. His most recent suspension was just a few months ago - Dec 20, 2017 to Jan 3, 2018, according to NorthJersey.com/The Record - which didn't affect him because that mostly aligned with the holiday break from school. A couple of sick days taken, and no one missed him. That's likely how he's been skating all this time... let things happen while school is out so it never affects his job.

And I agree with your acknowledgement that mandatory retirement might hurt a few good drivers. But as they say in sports, better to cut a player a year too early than a year too late.

Any directly hired bus driver, full or part time, doesn't matter, should have had his lifelong driver extract pulled. It takes seconds to do and these is no excuse why these bloated school administrator staffs, who eat up 67% of our property taxes, had their fingers up their asses.

If I were one of the victim's family members, I'd be suing that school system out of existence.

But guess what. The hipaa privacy laws that were put in place to safeguard your personal medical records can be manipulated to obfuscate an underlying medical condition from a prospective employer for a cdl bus driver. Saw several guys cobble together 2 weeks vacation one year onto 2 weeks vacation from next year and
undergo cardiac procedures. And thanks to hippa privacy laws their employers (whether it be NJT or local school districts) didn’t have a clue. Find a soft touch cdl physician for your next physical, leave a few details missing from your paperwork and you’re good to go. The solution is pick an age date and cull the herd. Until then if there is a loophole someone will find it.

We are talking about state driver records. HIPAA doesn't cover that.

License suspension for parking violations just means he is a deadbeat. I don't much care about that. But there were also moving violation suspensions and numerous speeding tickets. They are hard to get in NJ given the way speed limits are disregarded, except on quota day in a borough to enforce 25 MPH.

Joe, I understand where you’re coming from but I feel that 14 suspensions reveals an inclination to deviate from the norm. Kinda like the “ Broken Windows ‘ approach to law enforcement in NYC prior to Deblasio. Continued disregard for minor infractions paves the way for irresponsible behavior at a higher level. There’s no way the maneuver that this guy pulled was spur of the moment. This was ingrained behavior.

14 suspensions is an epidemic, or as you say "ingrained behavior".
1 to 4 (at most) is a deviation.
Driver Abstract would have revealed it all. He'd stick out like a sore thumb, but they were grossly negligent in having such in their protocol. .

Failing to report moving violations, even when occurring in a non reciprocal jurisdiction, would get you in serious trouble if you got caught if you were a NY MTA driver.

I'm not saying his age is his crime or a crime in anyway but I know a couple folks that age if rather not have drive my kids around let alone in a school bus.

Lost in all this is Mendez trucking. Countless tickets for countless violations. Any body here think that Mendez was in the right lane observing the speed limit? No, probably highballing it, either overloaded from his first trip or flying to pick up his first load of the day. His only saving grace was that he encountered someone more reckless than he was. I drove the N.J. turnpike for a long time, it’s a Roman chariot race everyday and the troopers for the most part disappear during the am/pm rush. It’s too dangerous for even them to pull the worst offenders over.

The dump was fully loaded and was in the center lane at the time of the crash. The NJDOT video showed the driver attempted evasive maneuvers but because the bus straddled the entire highway, he had no way of avoiding a collision. Good friend of mine who was a long-distance trucker for years said braking usually isn't an option on the highway - the first reaction is to find room to steer around something, because there's no time or room to brake fully. The Morris County Prosecutor's Office and NJSP have effective absolved the truck driver of fault or wrongdoing.

Yes, Mendez Trucking has a spotty FMCSA file. But if (when) Muldrow is convicted, Mendez can join the lawsuits against Paramus. Mendez can sue for a new truck (well into 6 figures for that class/configuration), loss of use until the new rig is delivered, loss of use of the driver until a new one is hired, and recovery of any contractual penalties for non-delivery of that load by their client.

I understand . I understand. It is all on Muldrow in this case. It’s just that I’ve seen so much recklessness over the years and sometimes it takes two to tangle. I’m done with this thread and I’m done with cdl driving. Happy motoring.

Correction. Not quite done. I’ve watched Mendez trucking dumps driving like lunatics on the njtp for as long as I can remember. Always pushing, always obviously looking for the next load. I’m sure prior to the Mt.Olive collision this guy had blown thru numerous lane changes and tailgate intimidations.. Take a look at his driving record. Yes, in this particular snapshot in time he comes out smelling like a rose. Only because he found by sheer luck somebody more irresponsible than him. It takes a village to have a collision. I’ll bet somewhere in the Mendez corporate office they’re breathing a sigh of relief.

Of all truckers I encounter, dump truck drivers seem to be the stupidest. In this case the Paramus school bus driver out did them in that category.

See what happens to their school taxes in the 2019-2020 bill next summer after the insurance companies have at them, and the stupid school administration board will act like victims
