The dump was fully loaded and was in the center lane at the time of the crash. The NJDOT video showed the driver attempted evasive maneuvers but because the bus straddled the entire highway, he had no way of avoiding a collision. Good friend of mine who was a long-distance trucker for years said braking usually isn't an option on the highway - the first reaction is to find room to steer around something, because there's no time or room to brake fully. The Morris County Prosecutor's Office and NJSP have effective absolved the truck driver of fault or wrongdoing.Yes, Mendez Trucking has a spotty FMCSA file. But if (when) Muldrow is convicted, Mendez can join the lawsuits against Paramus. Mendez can sue for a new truck (well into 6 figures for that class/configuration), loss of use until the new rig is delivered, loss of use of the driver until a new one is hired, and recovery of any contractual penalties for non-delivery of that load by their client. |
