Last year I was the QC dispatcher at MTV and the hours were 6p-2a.
Last year I was pulled over more by the police than ever. Once by the NYSP, twice by the NYSPP, twice in my local town and once by the NYPD in Washington Heights!
All the times nothing happened. I wasn't speeding or drinking just bored police officers late at night.
I never got smart, just answered the questions and I was on my way home. I know if I did get smart something bad may have happened, but I just want to get home.

London is legal so long as you don't use a flash, and staff are known to remind you about the no flash rule but otherwise let you go about your business. Not sure what the rule in Paris is officially, I had no problems aside from one T/O gesturing not to take photos.

And it shouldn't come to mind. The first amendment has nothing to do with this matter. Here is what the first amendment says:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

The first amendment only restricts CONGRESS from enacting the types of laws mentioned in the amendment. It does not apply to individual states or municipalities, or to private organizations. The first amendment does not prevent a company, for example, from adopting a regulation prohibiting its employees from saying "flibbledunk" in the office during business hours. It amazes me how often people try to lean on the first amendment as the source of their right to say anything at all, to anybody, at any time. That simply is not the case. It may very well be that the officers involved acted improperly. However, it has nothing to do with the first amendment.

Well, why are there two sets of rules? If photography is to be banned, it should be known to the public by posting that law somewhere in the public's eye. Signage! I mean, having two sets of rules is f___ed up. Intimidating New Yorkers!? WTF? Makes no sense. If you are taking a picture of a choo choo train, your inyentions are sort of obvious. No? 1984+. I am traveling to NYC from here out in the sticks of Pennsyltucky in two weeks and had intended on taking my Canon along. As my friend from Queensland, Australia used to say "FUCK!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!"

It does restrict states and municipalities but not private organizations. Both state and local laws can be declared unconstitutional if found to violate ANY clauses or amendments to the US Constitution.

They tried to pass a photo ban and it failed. The city also tried to pass severe restrictions on all public photography and that failed too due to protests and political pressure. So the only tool the NYPD is left with is fear and intimidation since the law is NOT on their side.

You have to understand we now live in a country of paranoia...just look at the Patriot Act.

Remember 7/7 in London? What was the first reaction...to shut off mobile phone towers in the tunnels (they sure couldn't stop mobile phone signals on the bridges).......

Goes on all the time today in this country. Hopefully under Obama, we can go back to being a country where the rights of the individual are protected although guys like George W. Bush and Dick Cheney cringe at the thoughts that people in this country actually have civil rights......

The first amendment applies only to Congress. It's the fourteenth amendment (pertinent text below) which prohibits states from enacting laws that would deprive citizens of their constitutional rights.

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

So then the fourteenth amendment prevents states from countermanding the first amendment. Either way the first amendment is the law of the land and no state or local government has the power to limit free speech except for those limitations that the Supreme Court has ruled can be enacted (i.e. child porn)

Why should this "change" anything for him. Is there anything in the TA employee handbook or rules that forbids "them" from taking photos on TA property? I doubt it.

And don't always assume official credentials will get you by. Before the N. J. Transit photography policy was clarified, I was with a visiting official from another transit system. He wanted to photograph the exterior of the historic Hoboken railroad terminal. We were descended upon by a group of NJT police officers. Showing them my NJT credentials, handing them my business card and explaining the situation meant nothing. We were told that photography there was not permitted and told to leave. I was told that I'd have to take it up with the office. It was a weekend and there was really nobody I could call. Needless to say, I was embarrassed. But, I didn't argue with them. In fact, I thanked them for taking such good care of our property. That was the diplomatic way to handle it.

I do not disagree with you. Believe it or not, we still need law enforcement. We can't pick who serves, but they serve anyway. Tact, vision, thoughtfulness. Maybe cops don't think along those lines. But they are necessary just the same. This is something that needs to be made public, highly visible in the public eye to generate official involvement. I see no other way to end it. Bottom line: They all must communicate and get on the same page so we know what are roles are. Then, we can get on with other things that need attention. This is almost too silly to be taken seriously.

But my point is that there's plenty of it, even modern day photos, in magazines, books, the internet, etc. What's the big deal of taking photos of trains! There are lots of worse things in life that people do. Why do police officers get so uptight about taking photos of transit vehicles or stations. The whole thing is nonsense!

He was not arrested, only detained. He received a summons for "illegal" picture taking (in the eyes of NYPD), which he would have received even if he was not detained. Therefore this is not a criminal matter. By detaining him the cops are trying to discourage him from taking pictures in the future. He has a right to take the matter to court and fight the summons by submitting the TA rule allowing photography to the judge. The other 2 summons' are subjective ones and the judge would have to decide based on the testimony of all parties involved. Of course 3 vs. 1 the cops will always stand up for each other. It comes down to this guy getting a lawyer, which would cost more than the 3 summons' unless ACLU volunteers to defend him if it goes that far. Even if he wins, it will not set new NYPD policy. Last year I was the quality control dispatcher at Music Television.

Last year I was pulled over more by the police than ever. Once by the NY State Police, twice by the NYS State Park Police.......

Did I get that right?
