IRT El cars ran underground on 9th ave-Jerome services til the end(and maybe longer. Was the polo grounds shuttle Low/High V from the beginning?). Q types ran underground in Flushing, and they were rebuilt for the 1939 worlds fair, and ran there well into the 1940s. Manhattan El cars ran on the Dyer ave line from when it was taken over into the 1950s, and the Dyer is largely underground.I don't think the ban ever actually happened. |

Polo Grounds Shuttle had El cars replaced with Composites in June 1940, shortly before or after unification & the abandonment of the 9th ave. el. They operated there until March 1950.El cars did run through the tunnel prior to that date, but this was probably not considered a subway - just a short tunnel a few blocks passing under the Ogden Ave. Ridge (thanks for that cite Roger Arcara!) Q-Types (rebuilt BRT gate cars) and regular BRT gate cars could operate to Main St. terminal, due to their design containing more steel than Manhattan el cars. re: the ban, please look at my first post, where I cite the PSC ban of Composites on the IRT main subway lines, as being 1915. Issue here being questioned, is ban date: 1915, or 1918 after Malbone St. Thanks. |

For some reason, the PSC seemed a little more liberal with the BRT/BMT than with the IRT although the IRT continued to operate all wooden el cars through the Sedgwick/Anderson Av tunnel on the 9 Av El (later Polo Grounds Shuttle) even after the ban. There were also certain places line Main St/Flushing and 9 Av lower which were subway in construction bur wee parts of elevated lines. Technically at the time that the C types were first placed into service, the Centre St Line was a small part of the Bway Bkln El and that may have been the reason those cars were allowed there. I recall an old timer mentioning that he saw trains of C types on the Jamaica Line in service but that may just have been when they were new and only for purposes of qualifying crews. |

Now that I look at it, there may have been a loophole in the wording in the PSC's directive. The ruling bans wooden cars from SUBWAY lines, however, some of the places where wooden cars continued to operate such as 9 Av LL, Main St and even the Malbone St tunnel which gave rise to the ban were not subway lines per se but rather short underground portions of ELEVATED lines which is probably why they were allowed. |

I wondered about the same thing in an earlier post:"El cars did run in [the PGS tunnel] prior to that date, but this was probably not considered a subway - just a short tunnel a few blocks [long]." And I also was told years ago that: Q-Types (rebuilt BRT gate cars) and regular BRT gate cars could operate to Main St. terminal, 'due to their design containing more steel'* than Manhattan el cars. *I wrote this as a general description, since I didn't quite remember the specifics - more steel in the undercarriage design or in other parts of the BU's/Q's as well? |

The original owner's claim to the rest of his property is unaffected. The abandoned ROW is one single entity. If someone encroaches on the ROW, they'll only have an adverse possession claim to the part they encroach, but if they're able to encroach in the first place it means the nominal owner of the ROW hasn't been exerting property rights to any of it. |
