The people who are saying "Trayvon got justice with Zimmerman being charged with "2nd Degree Murder" think about this... The Definition of 2nd Degree Murder is characterized by a sudden and instantaneous intent to kill or to cause injury without caring whether it kills or not.. the charge basically is that Zimmerman decided to just shoot him for shooting him. Zimmerman has "Stand Your Ground" and he will claim self defense. Casey anthony got away with her murder change due to the fact that the charge was too hard to prove this might be the same. In Florida first degree manslaughter is when "The killing of a human being by the act, procurement, or culpable negligence of another, without lawful justification" The state has to prove intent, as long as Zimmerman can claim self defense and prove it he can get off. Also its likely Zimmerman would try to get his Lawyer to say that this trial CANT be done in Florida because he'll make the claim that he wont find a fair jury. This might very well turn into Casey Anthony Part 2 |

I think Zimmerman should've been charged with Manslaughter... since its with a gun it would've automatically been a first degree charge and they could've said Trayvon was a minor which means an automatic 30 year sentence if found convicted. So I think Florida screwed up BIG TIME by trying to appease the populace with the 2nd degree murder charge. If he got the Manslaugter charge I think he would be found guilty. |

I think that he should be charged with whatever meets the statutory threshold in the Florida legal system and then let it be decided by a judge and 12 jurors. Since none of us are there and none of us a privy to all of the facts, it makes more sense to watch this play out instead of taking sides like this is some sort of sporting event. Zimmerman had stand your ground while he was in his truck. Since he was NOT on a scheduled patrol he was not acting in the capacity of a watch member.When he left his truck he was technically trespassing. He lost his ground at that point. Trayvon Martin had the right to be where he was. He was a guest of a resident, who was also his guardian at that point in time (his father) in the development. Trayvon Martin had the right to stand and defend his ground, his right to walk home, meandering as he was while talking to his girlfriend on the phone. Lollygagging isn't illegal. Zimmerman was following this kid for a good amount of time, acted in a menacing manner and then shot him. He may not have meant to kill him, yet his menacing behavior is in a manner compatible with the 2nd degree murder statute. |
