Posted by GP38/R42 Chris on Mon Mar 12 19:10:29 2012 Starting March 15, all hotel pools will now require hotels to have permanent lifts to get ADA guests in the pool. They can't use portable units, that's not good enough, and they have to equip every water facility on the property, and that includes, hot tubs, or if they have multiple pools.Once again, common sense can't prevail. What's wrong if they only have one of the pools ADA reachable? And permanent lifts in hot tubs? What's wrong with the portable ones? Another law which completely disregards common sense. I think that people should start to sue the federal government because national sea shores are not wheelchair accessible. Every national sea shore should have a paved strip for use by those in wheel chairs.There is no common sense left. Great, so they have a lift. Now people without the use of their legs can get into a pool. Now they'll have to have a life guard as well. Look for hotels to comply by closing their pools instead. |

As a matter of fact - my brother was born with Cerebral Palsey in 1958. I have been dealing with his condition for over a 1/2 century. While at one time he was able to walk with crutches and braces, his hips have degenerated to a point where he is wheel chair bound. That likely tops any such experience that you have with the subject. I also founded and was the Scoutmaster of Troop 794 in Queens in the 1970s. The first scout troop (not affiliated with a hospital)for physically challenged children. Again, likely more experience with the physically challenged than most here.Knowing the issues as intimately as I do, I can say that while the ADA does provide some very important protections for the disabled, it puts out some idiotic regulations where the cure is worse than the problem it attempts to solve. This will be one such example. Before hotels will provide lifts and life guards, they will close their pools because it will make more business sense to do so. When I took an ADA compliance course, the ADA required adaptations be made to give the handicapped access if, in general, the cost was under $5,000. Now, that threshold may have been raised but the costs associated with such a modification will easily exceed that amount. Now, since do not usually choose hotels based on the availability of a pool, the hotel owners will opt to close their pools and make more profitable use of the space. |

This has nothing to do with thinking ADA laws are bad. They are good, but common sense has to prevail too. The reasonable accomodation stipulation made sense. This does not. There's nothing wrong with the older portable lifts that were available, or made to be required. But to have permanent large lifts a requirement at every water location, including small hot tubs is absurd and over the top.Hotels will just fill in their hot tubs or many the whole pool, and then no one gets to enjoy it. |

February 24 clarification letter from the Department of Justice The 2010 Standards apply to "fixed" or built-in elements. A "fixed" element is one that is attached to a covered building or facility. Therefore, for an existing pool with less than 300 linear feet of pool wall, for example, removing barriers will involve providing one accessible means of entry, meaning a built-in or "fixed" pool lift or a sloped entry that complies with the 2010 Standards to the extent that it is readily achievable to do so (larger pools with 300 or more linear feet of pool wall are required to have two accessible means of entry, with at least one being a pool lift or sloped entry). If, in our example, an entity chooses to use a lift complying with the 2010 Standards that is removable or otherwise designated as "portable," it may do so, so long as while the lift is provided at the pool, it is affixed in some manner to the pool deck or apron. If installation of a fixed lift or sloped entry is not readily achievable, then a public accommodation may consider alternatives such as use of a portable pool lift that is not affixed to the pool facility but incorporates features that in all other respects comply with the 2010 Standards, or the public accommodation may consider other readily achievable accessible means of entry, such as a transfer wall or pool stairs. However, the 2010 Standards' emphasis on the provision of a lift or a sloped entry recognizes the fact that many people with mobility disabilities rely more heavily on these means to independently enter and exit a pool. |

The DoJ clarification says portable lifts are permissible where fixed lifts are infeasible, and that each pool must have a lift. The letter is asking the DoJ to permit portable lifts in all cases, and to allow the hotel to have one portable lift that a guest can "sign out" and carry around with them. |

It's hardly insane. Once the physically challenged are in the pool there will have to be attendants to assist them in and out of the lift and to insure their safety. This, obviously is not the same as a one-time investment. This is one or more positions each shift 7 days per week. Perhaps this is part of obamas jobs creation plan. |

Exactly. There are many hotels (most?) that don't have lifeguards, nor attendants at the pool. Having wheeelchair people go in the pool and the operation of the units will mean attendants would always need to be there.The Democrats just love making huge government for everyone. |

The 1990 ADA allows small businesses to take a tax credit of 50 percent of the cost, up to $5,000, of certain accommodations. All businesses are allowed a tax credit of up to $15,000 to cover the full cost of removing certain architectural barriers. |

If the hotels were opposed to having an attendant, why are they lobbying to have a single portable lift for multiple pools? That would require an attendant to transport the lift and set it up every time someone needed to use it. |
