Zoning was part of their other noxious policy: setting civil rights back half a century -- if you keep suburban municipalities a museum for rich people, it should combine with public sector education to keep the niggers out of the neighborhood. Never mind that it screws over poor whites too -- they're mainly Dagos, Spicks, and Leprechauns anyway. The whole thing is a sick joke, built upon propaganda interpretations of real public health issues and that curious late-19th-Century back-to-the-land anti-human-society movement. No, but it's been held to be within the reach of a State's "police power". And it's widely documented on Subchat quite how much the police can be the enemy of the people. They're essentially being used to circumvent the 3rd Amendment, which expresses a magnificently 18th-century concern for the sorts of liberties affected in the most ineffective language possible. Mercifully it's being very, very slowly phased out in NYC, which is at least some progress. It's nowhere near enough in terms of returning to the values that made America great. Yes, those values also produced Tammany Hall, but a little corruption is better than a sentimentalist socio-economic suicide. |

Surprisingly, Euclid was decided in an era that was rather cordial to (classical) liberal arguments in certain other spheres, e.g., minimum wage, labor unions. The boys could tolerate a whole lot of cognitive dissonance, though, if you appealed to their morals, e.g., you need to protect women (because they are weak and stupid; cf Muller v Oregon), and zoning (because this controlled the nuisance of cities expanding and corrupting the countryside). 2. The third amendment did get some love in Justice Douglas's opinion that prophylactic use is legal (Griswold v CT); he adverted to the privacy concept implicit in the specific constitutional prohibition. |

It hasn't been established how zoning led to rent control.It led to perverse incentives, e.g., making apartment buildings harder to build, thus limiting the supply of apartments, thus raising rents, and of the modern-day defenses of rent control along the lines that abolishing rent control in the face of zoning regulations won't lead to the advantages of a free market in which developers, landlords, tenants, and purchasers all do better. That's got nothing to do with the Supreme Court. Sure it does, at least if you view the takings clause as applicable to the states per section one of the fourteenth amendment. Both zoning and rent control were challenged as takings, but the courts upheld both. And even if you don't, most states have a takings clause-like provision in their own constitutions. The Tenth Amendment allows states to assert that at their discretion. See above. |
