That the County Clerk of a county with thousands of people actually personally signs most documents.That's a very unreasonable assumption in a county with millions of people, but not in a county with thousands of people. Since the average person gets married roughly once per 80 years of life, a county of 10,000 would have 5,000 weddings in 80 years, or only 63 per year. Not too big a work load for a county clerk. (Yes, I know they do other stuff. But still, the clerk of a county of 10,000 or maybe even 25,000 doesn't need an assistant to sign forms and probably doesn't have one.) |

The county clerk issues marriage licenses (KRS 402.080) and files and records all marriage certificates (KRS 402.220 and 402.230). Military discharges may also be recorded in the county clerk’s office (KRS 422.090). On or before the 10th day of each month, the county clerk reports to the state registrar of vital statistics all marriage licenses issued and all marriage certificates returned (KRS 213.116). Each county clerk must furnish each applicant for a marriage license with a copy of a marriage manual to be prepared and printed by the Human Resources Coordinating Commission of Kentucky (KRS 402.270). |

The Clerk in KY also oversees voter registration, vital records and other stuff like that. It's pretty obvious that she doesn't personally sign all these documents but instead merely has her name printed on them. Document and license issuance stops when she goes on vacation or if she's sick? |

Even in a small village clerk's office, there's usually at least two people working there at any time, fully authorized to sign on behalf of the official "Clerk". Counties often have a few more bodies on board. |

What's ridiculous is that in Kentucky, a couple can get a marriage license in one county and get married in another county. At this point the couples suing the clerk are looking for notoriety because they could have gone to a different county; gotten a marriage license; and then get married in their "home" county. |

Laymen rarely understand statutory interpretation.Robert Stivers, the president of the Kentucky state Senate, has asked a federal judge to withhold his ruling ordering Davis to issue marriage licenses to same-sex couples against her religious beliefs. Why? Because he wants to give the state legislature time to pass a law that would exempt her from issuing marriage licenses. If anyone in the Clerk's office other than Davis was authorized to grant the license, the legislature wouldn't need to pass this legislation. |

Until your post, I never even thought of the issue of whether she had to personally sign these documents, but it is obvious from your hypothetical that there is some sort of contingency even if she does personally sign some documents. The only explanation that makes sense is that any of her subordinates approving the documents is the equivalent of her approving them personally, which is why she doesn’t allow it. |
