When an agent of the state imposes her religious beliefs on the people, that is called theocracy. We fought the Revolution to get away from being governed by a theocratic monarchy, among other things.

Elected officials may NOT impose any religious test as a condition of performing their sworn duties. When such an official specifically refuses to do her job because of a court ruling clarifying the right of gay and lesbian Americans to marry, that's homophobia, no matter how she tries to cloak it in the veil of religious fervor. It's also patently illegal.

Then why doesn't Davis just resign? Then she can publicly protest same sex marriage to her heart's content. The fact that she will neither quit, nor comply with a court order in a case to which she is a party, strongly suggests she has a problem with gays and lesbians, and their right to marry those they love. It's not principled opposition, it's hatred dressed up as faith.

"KRS Section 402.080 provides the proper venue for the issuance of a marriage license. That statute states:

'No marriage shall be solemnized without a license therefor. The license shall be issued by the clerk of the county in which the female resides at the time, unless the female is eighteen (18) years of age or over or a widow, and the license is issued on her application in person or by writing signed by her, in which case it may be issued by any county clerk.'

Who's issuing them on the other 145 days?

That includes 52 Saturdays 52 Sundays and 10 holidays when government offices are closed. I don't thing the clerks actually do need to sign off but it wouldn't by physically impossible.

What important constitutional law issue is there here?

Unlike Olog, most of the rest of us accept that once the Supreme Court rules, it is the law of the land. (Though if they rule just on a legislative issue, the legislature in question can overrule the decision by passing new legislation.)

The Court ruled. Obergefell is as much the law of the land as Citizens United. So public officials in charge of making marriages happen are expected to make gay marriages happen too. The Supreme Court made that clear by declining to hear Davis's appeal for an exemption.

Yes, there is a Kentucky state law issue as to whether a deputy clerk can issue a marriage license against the wishes of the County Clerk. If they could, the judge could release Davis from jail and the deputies could just issue licenses. It's an interesting issue, but it sure isn't very important. (One could argue that Kentucky as a whole isn't very important.)

so somebody filling an elective office in Louisville and surrounding area and who is personally responsible for overseeing complex legal and administrative matters such as elections, death, births, marriages and so on and has to make difficult decisions all day, attend many meeting with staff, peers, other elected officials, plus other responsibilities that would include travel, etc will somehow spend his/her entire workdays signing people's marriage licenses?

Does that make any sense to you?
