Not yet. The grand jury is evaluating the evidence. If they issue an indictment he'll be charged. In MO it takes 9 of the 12 jurors to consent to file a charge. The jury also could choose to file lesser charges.

The makeup of the jury is 75 percent white: six white men, three white women, two black women and one black man. The county overall is 70 percent white, but around two-thirds of Ferguson's residents are black.

but around two-thirds of Ferguson's residents are black.

And sadly, they destroyed their own neighborhood in the looting and riots. Similar to what happened in the riots in New York in the late 70's. It took Bushwick 30+ years to recover from a few days of rioting.

It wasn't the people of Ferguson that were out there looting. Far and away the majority came from out of town. According to the AP, out of a little over 180 arrests, only SEVEN (7) were Ferguson residents.

Law enforcement officer's use of force in making an arrest.

563.046.
  1. A law enforcement officer need not retreat or desist from efforts to effect the arrest, or from efforts to prevent the escape from custody, of a person he reasonably believes to have committed an offense because of resistance or threatened resistance of the arrestee. In addition to the use of physical force authorized under other sections of this chapter, he is, subject to the provisions of subsections 2 and 3, justified in the use of such physical force as he reasonably believes is immediately necessary to effect the arrest or to prevent the escape from custody.

  2. The use of any physical force in making an arrest is not justified under this section unless the arrest is lawful or the law enforcement officer reasonably believes the arrest is lawful.

  3. A law enforcement officer in effecting an arrest or in preventing an escape from custody is justified in using deadly force only

    1. When such is authorized under other sections of this chapter; or

    2. When he reasonably believes that such use of deadly force is immediately necessary to effect the arrest and also reasonably believes that the person to be arrested

      1. Has committed or attempted to commit a felony; or

      2. Is attempting to escape by use of a deadly weapon; or

      3. May otherwise endanger life or inflict serious physical injury unless arrested without delay.

  1. The defendant shall have the burden of injecting the issue of justification under this section.

To say that the officer would "avoid being found guilty" means that the prosecution, should he be charged with a crime here, has a valid case but is bound to bungle it.

Facts WRT the "tussle", as witnessed, are not clear.there re witnesses that saw wilson walking around the scene and the body for up to two ours after Mr Brown was gunned down, appearing uninjured and clear of mind. There was a report he drove his police cruiser away from the scene, which is a violation of procedure. As I said, based solely on clearly established fact.....

The fact that we, 2+ weeks out do not have these facts should be the greatest concern. By this point in time in NYC we had clear proof that Eric Garner died from the police chokehold, had the name of officer involved and all other pertinent facts, and within a month charges were filed. In LA, the police were handling community outreach over the shooting of Ezell Ford as the facts were being made public.

Those are two examples of better handling of police initiated tragic shootings. Nothing of the sort was or is being done in Ferguson.
