When a policeman asks you to do something, you comply (unless it is something outrageous).

There's a big difference between "put down that gun or I'll shoot" and "turn off your camcorder". One should be able to seek clarification about the latter without the situation escalating, unlike the former.

As I said, it depends on the tone of his voice just as much as the words he used. He could have said it in a way that escalated the situation. If not, you're right, he should have been entitled to an explanation. But what were they going to say, "We don't want you to have a record in case we do something wrong?"

On the other hand, a record could be for their protection too. Look at all the police cars equipped with camcorders these days around the country.

To me, asking "what would happen if I refused to shut it off" sounds like a challenge. Once an adversarial relationship starts it's hard for either side to back down. The funny thing is, if he said "I'm really sorry, I just like to take pictures of trains and I'd really like this shot" there is a chance the cops would've let him take the pictures. And if they didn't there's still another time.
In my 21 years as a cop, well at least the 16 yrs before making supervisor (sergeant) I probably let half the people I stopped for traffic violations go with a warning. But I very rarely let someone go who started with an attitude.

Better on those boards than here. Not to dog anybody, but posts like these do cause some flaming especially when no one really knows the official deal about the photo taking regulations other than the higher ups of any transit agency. Sometimes that piece of paper we carry means jack zhit when crews and police are not properly informed from higher-ups so we really can't blame train crews and police because they happen to be in the dark with us. I've pretty much limited my pic taking for a while but send a nice batch to Dave Pirmann whenever I decide to venture out. Either way, we gotta do what we gotta do. If another railfan photo protest has to be done again, so be it. One way or another, this will be fixed. Also for Nilet, be sure to check out NY 1 News, and 7 On Your Side, not to mention Arnold Diaz's Shame on You. Hook up with any or all of these news media sources and hopefully the MTA will wake up, smell the Bustello and make sure all police and train crews are aware of our rights to take pics of trains. A completely safe and legal hobby.

If another railfan photo protest has to be done again, so be it.

But how will railfans get pissed off enough so that they will finally organize a protest unless these incidents are reported on the boards they read? Besides the MTA (and now the NYCLU) reads this board.


One way or another, this will be fixed.


It won't be fixed if there won't be a public outcry. And there won't be a public outcry if people don't know what is happening. OTOH keeping quiet will fix it the way the MTA wants...

Exactly what the MTA wants - they post rules saying photography is legal while at the same time making sure that everyone is intimidated into not excercizing that freedom.

Why don't you put your money with your mouth is and go out with a known trouble-maker. This way, when he's interdicted by legal authority, you can intercede and tell them where to go. One of the photographers in my photo club told me today that he was stopped from taking a picture FROM the window of a NJT train (and he is not even a railfan). The problem is really widespread.

The guys like Nilet and others and the guys who continually go to the American Criminal Liberties Union are going to ultimately screw it up for the peaceful railfan-photographer who knows how to remain civil and avoid the "big-ball" confrontations. Instead of the railroad properties having to defend themselves from the ambiguities of their own policies (that try yo balance everyone's needs), they will simply re-write those policies to ban all photography anywhere on system property. In the long run, it'll be cheaper.

I just have one more question. At Hoboken, is it fine to walk up to the locomotives and take pictures of them? I tried to do that yesterday but a conductor stopped me and said that I couldn't because I would get run over (I don't know what he meant by that as I would never walk on the tracks, but whatever).

Actually that won't be cheaper. There was a huge public outcry the last time the MTA tried to ban photography in the system and this time it would be even worse. New York's attempt to regulate street photography had the effect of organizing the amateur photographers and independent film makers. Should MTA ever try to do that again there will be HUGE protests - and believe me not just railfans.

NJT and Boston's MBTA both rescinded photo restrictions rather than fight the ACLU. The problem is that what they say officially to the public is not the way it is being enforced on the ground. To put it in perspective what the MTA is doing is actually a minor piece of the whole problem. Tourists have been harassed for taking pictures of the White House. Silver Springs Maryland tried to enforce a photo ban on one of its streets. A woman was harassed for taking pictures of Christmas decorations in Greenpoint. A photographer was told that taking pictures OF the Time Warner Building is illegal. Another photographer was told "no pictures - this is Bear Stearns block". Collectively all of this MUST STOP!

I do not see the individual employee or cop as the problem any more. I see it as an official problem - someone in authority is telling these employees and cops to harass photographers and the only organization that can address that effectively is the ACLU.

Which Nilet does. He posted his last encounter here, and as he described it, the police were in the wrong. The CCRB agreed with him in its final ruling. That's strong evidence that Nilet's account of that incident was honest. I don't see why this would be any different. You have no reason to doubt him, as he has never been shown to post lies in the past.

Recently ridden isn't the same as waiting to board the train. From a tresspassing perspective, the license to be on the platform in the case of the former extends to leaving the platform, not standing around taking pictures.

Says who? IMO it is perfectly reasonable to be able to take photos both on your way TO the train and FROM the train after getting off. That's Amtrak's policy as well.

I know of no prohibition. I have gone to Hoboken and done just this. And many other photographers do it as well. Just carry your George Warrington letter with you no matter what. And if some irresponsible employee yells at you, you can always go down the next platform instead, then a little while later come back to the platform you wanted to go down and try again.
