To me, asking "what would happen if I refused to shut it off" sounds like a challenge. Once an adversarial relationship starts it's hard for either side to back down. The funny thing is, if he said "I'm really sorry, I just like to take pictures of trains and I'd really like this shot" there is a chance the cops would've let him take the pictures. And if they didn't there's still another time.In my 21 years as a cop, well at least the 16 yrs before making supervisor (sergeant) I probably let half the people I stopped for traffic violations go with a warning. But I very rarely let someone go who started with an attitude. |

Not to dog anybody, but posts like these do cause some flaming especially when no one really knows the official deal about the photo taking regulations other than the higher ups of any transit agency. Sometimes that piece of paper we carry means jack zhit when crews and police are not properly informed from higher-ups so we really can't blame train crews and police because they happen to be in the dark with us. I've pretty much limited my pic taking for a while but send a nice batch to Dave Pirmann whenever I decide to venture out. Either way, we gotta do what we gotta do. If another railfan photo protest has to be done again, so be it. One way or another, this will be fixed. Also for Nilet, be sure to check out NY 1 News, and 7 On Your Side, not to mention Arnold Diaz's Shame on You. Hook up with any or all of these news media sources and hopefully the MTA will wake up, smell the Bustello and make sure all police and train crews are aware of our rights to take pics of trains. New York's attempt to regulate street photography had the effect of organizing the amateur photographers and independent film makers. Should MTA ever try to do that again there will be HUGE protests - and believe me not just railfans. NJT and Boston's MBTA both rescinded photo restrictions rather than fight the ACLU. The problem is that what they say officially to the public is not the way it is being enforced on the ground. To put it in perspective what the MTA is doing is actually a minor piece of the whole problem. Tourists have been harassed for taking pictures of the White House. Silver Springs Maryland tried to enforce a photo ban on one of its streets. A woman was harassed for taking pictures of Christmas decorations in Greenpoint. A photographer was told that taking pictures OF the Time Warner Building is illegal. Another photographer was told "no pictures - this is Bear Stearns block". Collectively all of this MUST STOP! I do not see the individual employee or cop as the problem any more. I see it as an official problem - someone in authority is telling these employees and cops to harass photographers and the only organization that can address that effectively is the ACLU. |
