Posted by Newkirk Images on Wed Nov 18 05:40:45 2009 LINK TO ARTICLEJACKSON, Miss. — Helen Gable was taking pictures on the railroad tracks in Tupelo in 2006 when a train nearly cut off her leg as she tried to get out of the way. Gable and her husband are suing the railroad company for nearly $6 million. Gable says the company should have posted trespassing signs to keep people away. The lawsuit also claims the train was exceeding federal speed limits and that a cable was hanging off the side and cut her. BNSF Railway Company spokeswoman Suann Lundsberg said the company is investigating and is sympathetic to Gable's injuries, but "she admits in her lawsuit filing that she was trespassing" to take photos on the track. Lundsberg also said BNSF has equipment that detects if something is hanging or dragging from a train. Bill Newkirk |

Would she have paid any attention to the sigh if there was one.When you post "No Hunting" signs in North Dakota, you only have to post them at roads that enter the posted section, and at the corners of the section (ie 1 mile apart) If one wanted to see if hunting was permitted on a certain section, then one knows where to look to see if there is a sign. (Ergo you cannot just put "No Hunting" signs along the fence line and expect them to somehow be valid. BTW: this year we posted "ASK" signs, telling that we permit hunting, but please come to our office and ask permission. We will tell you where the cows are (you don't shoot at the cows or buildings.) and we will tell you where the game that we want to get rid of will usually be found. But this lady already *knew* that she was not walking on her own property, and that the property with the shiny steel rails was probably arranged by somebody for some purpose. If she does not know what a railroad is, then she should not be let out side of the plastic bubble that she was spawned in. ROAR |

While the terms are exactly right, I would like to see what level of reasonable expectation a railline has to think about to keep ppl safe in such circumstances. Otherwise, no case. How is she going to prove a burden on the railway when said railway is claiming the detectors found NO defects. That's like a reverse uncalibrated radar gun for the speeder defense. |

Eh.Good rule of thumb: Whenever you hear of a suit involving massive damages for a clearly frivolous claim, you'll find that more often than not either 1. It never really happened— no damages were awarded or the entire case was an urban legend. or 2. It's not really frivolous— the information establishing the merit of the case was left out of all the news reports. In this case, I would imagine that the suit will end up in Category #1, No Damages Awarded. Of course, it's too soon to say— although the incident in question apparently happened in 2006, the case was only filed four (business) days ago.

Actually, tort reform is about protecting corporations and powerful interests from legitimate claims so that they can save money by using inferior materials and shoddy work without having to worry about lawsuits if and when people are injured by their products. |
