Good rule of thumb: Whenever you hear of a suit involving massive damages for a clearly frivolous claim, you'll find that more often than not either

1. It never really happened— no damages were awarded or the entire case was an urban legend.

or

2. It's not really frivolous— the information establishing the merit of the case was left out of all the news reports.

In this case, I would imagine that the suit will end up in Category #1, No Damages Awarded. Of course, it's too soon to say— although the incident in question apparently happened in 2006, the case was only filed four (business) days ago.
