Or it could be a field checker so wet behind the ears that he thinks the subway came first and the housing developer built the wall.Then it could be the office clerk who looked the address up to find the owner but was so short sighted that they didn't notice the easement to MTA in the land title. I think a suitable owner's reply would be to mention that a hundred years ago he sub-arranged for a patrol several times a week and has a full time engineering staff overseeing it. They are doing this far more frequently than every 5 years so please contact 2 Broadway, Manhattan to get the latest report. Bill |

The city still owns all the tracks, tunnels, rights-of-way, and structures of the subway system (this is why the old LIRR Rockaway Branch north of Liberty Avenue was never demolished and developed; the city got it from the railroad along with today's tracks to the Peninsula). The kicker is, that means the city (through it's portion of the MTA) is responsible for maintaining the retaining walls, as others here have pointed outOf course, if I owned a home next to the Brighton tracks, I would tell the city to redirect their correspondence on this matter to: The Brooklyn Rapid Transit Company 44 Court Street Brooklyn, NY 😂😂😂😂😂 |

The issue is that despite the resident being the owner of the underlying land, the government is the party that inherited the wall and thus is ultimately responsible for any risks it poses. This is where DOB didn't look far enough to see that it is inappropriate to hold the landowner responsible for risks his tenant's wall poses to the City when the City( DOB's boss) is that tenant.Then again a Canadian friend mentioned his Federal Fisheries Ministry's "fish protection" staff prosecuting the ministry's own "fish development" staff over a hatchery construction project. They had too narrow a focus to just talk about it through their common boss. Bill |
