The city still owns all the tracks, tunnels, rights-of-way, and structures of the subway system (this is why the old LIRR Rockaway Branch north of Liberty Avenue was never demolished and developed; the city got it from the railroad along with today's tracks to the Peninsula). The kicker is, that means the city (through it's portion of the MTA) is responsible for maintaining the retaining walls, as others here have pointed out

Of course, if I owned a home next to the Brighton tracks, I would tell the city to redirect their correspondence on this matter to:
