Silence, it is public ROW. The issue is that despite the resident being the owner of the underlying land, the government is the party that inherited the wall and thus is ultimately responsible for any risks it poses. This is where DOB didn't look far enough to see that it is inappropriate to hold the landowner responsible for risks his tenant's wall poses to the City when the City( DOB's boss) is that tenant.

Then again a Canadian friend mentioned his Federal Fisheries Ministry's "fish protection" staff prosecuting the ministry's own "fish development" staff over a hatchery construction project. They had too narrow a focus to just talk about it through their common boss.
