There's still valid though in "if you go looking for trouble, it will find you" here. Dunno how it works in Florida, but had that happened up here, Zim would be in the shitter for "failure to comply with a lawful order" just for continuing to follow. |

So if a person has entered your car and is driving away, you believe that it should be acceptable to shoot at the vehicle going AWAY from you, posing no danger to your person?Only threats to a PERSON should be met with deadly force. Entering an occupied home is such a threat. Stealing a car and driving off is not. Entering an occupied car (carjacking) also is. |

Does that apply only to sworn officers or can anyone in NY give lawful orders that must be obeyed? My limited understanding of the Florida law is that anyone that is engaged in a lawful act can stand their ground. Zimmermann certainly instigated, but he claims that he was walking back to his car. |

Sworn officers like the operators in the county sheriff's office that run our E911. If an operator there tells you to do something and you screw up and don't listen, you can get your three squares and a steel bed. The "walking back to the car" claim is one I haven't heard until now.But around here, you'll do hard time for a bad check. So we don't have much of a crime rate here. As to Florida law, dunno but again, around here, if E911 tells you to break it off and something happens, you'll be visiting the facility too. |

The 911 operator didn't tell him to back off. He said "We don't need you to do that." It sounds more like a recommendation than an order and certainly not something that anyone could be convicted for.And call me hard-headed, but I doubt that 911 operators have the authority to tell anyone to do anything. I've certainly never heard of anything like that. Even the police have gotten into trouble for telling people not to record videos of crime scenes. But a 911 operator can have the authority that you claim? That's hard to believe. |

Well ... one can always be governed accordingly. If I was in that situation and I was told by 911 "we don't need you to do that" I would accept that as "go away" and comply. I understand and I was once in a similar situation and was told something very much like that by a 911 operator and I complied. But it didn't sound like an order and I certainly never got the idea that I could be arrested if I didn't comply. The issue isn't whether you should comply, but whether or not it's a crime if you don't. |

I don't know what they do elsewhere but I do not believe that 911 operators in NYC or Long Island have any authority over police, fire or ordinary citizens. Perhaps this will help:Job Description Now that you know more about what does a 911 operator do exactly, you must read about all the 911 operator responsibilities and daily activities that the individual is expected to take upon himself. All these things are taught to the operator beforehand, but they should also come from within. This is not a job to be taken lightly, and requires a lot of commitment and will power. The many duties and responsibilities of a 911 operator are as follows. •Receive emergency and non-emergency calls and messages from the public and respond to them appropriately. •Respond to these calls in the right manner and inform the concerned authorities immediately. •Dispatch agencies or units who can provide assistance to the right address after highlighting the importance of the situation. •Prioritize calls and dispatches based on their importance, and take the right decision. •Operate on police radio frequencies to monitor and coordinate various police activities and assignments. •Maintain knowledge of the location and the status of various security personnel. •Create accurate logs of all public communications that have been undertaken for the purpose of general safety of the people. •Provide information for investigative purposes by making use of data and information available in sensitive security databases. •Maintain files and records for cases that require assistance in the future. •Maintain confidentiality of all the information dealt with. •Submit progress reports on trainees, provide on-the-job training for police dispatchers and stay informed of all departmental regulations and procedures. I guess it all depends on the jurisdiction and who actually handles E911. Some places, it's contracted with the telephone company. In other areas, it's contracted with national call centers who do that. I've even heard of some places down in the red states where your 911 call goes to India or Vietnam. Around here, in this county (after Verizon got people killed) it's handled by the county Sheriff directly. Can't speak for elsewhere, but that's how it works here. If a cop tells you to get off the sidewalk and go across the street, you do so. Maybe nothing will happen, maybe you get cuffed. That's all I was saying ... |

My guess, totally unsupported by any evidence, is that Zimmerman grabbed Trayvon and said some extremely impolite things to him (most likely invovlving words beginning with f and n), and Trayvon then started hitting him.Under NY law, Zimmerman would have no defense against manslaughter under those circumstances. Under FL law, if that's what happened he'll get off. |
