What if the person says they have no identification on them? Can they be arrested?

I haven't been listening to the radio or watching the news much the last few days and can't believe what I've been hearing today. The accepted discussion is even worse than subchat. People are outraged without any idea of what they are outraged about. All kinds of rumors regarding this law (see any post by bingbong on this issue) are accepted as fact. No one in the media or any of their guests seem to have read the law and are instead starting with the premise that white people in Arizona are racist and implementation of this law will be handled in a racist manner. How can you even debate people that make it up as they go along and have no interest in the truth?

Doubtful, since every police department is going to stop and question anyone they could imagine is suspicious or unknown to them. Since this law allows individuals to sue their local police departments if they perceive lack enforcement, so it will be over-enforced in order to avoid the possibility of expensive litigation.

The law says that police are required to make a reasonable effort to determine the status of people that they reasonably believe to be there illegally. Does what you posted sound "reasonable" to you?

The reality is that there will remain a palpable fear of litigation on the part of police departments. Many have already expressed this reservation in interviews about this law, as well as their fear of suits over profiling.

This is simply inaccurate. I don't think that this law will have nearly the effect that everyone is making it out to be. I was overly dramatic yesterday for comedic effect.

Do I like the law? No.

Is it this end of the world, Nazi, evil law? No.

Exactly. That's what I'm saying. I don't like the law but it's toothless and really was more of a "statement" than something that'll ever really be able to be put in practice.

It's an election year, and the Republicans wanted to fire up their base in Arizona as the Democratic candidate was leading the governor's race.

I'm guessing that the massive emotional response to this law will mean that it will be repealed shortly, but assuming that it were not police departments would have to enforce the law and not profile. It seems like a fairly easy thing to do. It's something that many police departments (mostly in cooperation with ICE) are already doing.

I heard on the radio that the DOJ has a team of people reviewing the law and "have not ruled out any option, including a lawsuit". Maybe it wasn't "lawsuit" but they basically said that they might challenge the law in court. Maybe that was the AG talking...I don't remember.

Actually, on a Constitutional basis, the feds would have to challenge the law unless someone else with standing challenges it first. The concept of any state attempting to challenge federal jurisdiction has to be addressed, or the feds would be derelict in their duty. Think of it in terms of an unchallenged "easement." If you don't enforce, then others can try it too. The legal basis for the civil war was similar.

So I can see that some droid had to do some paperwork just in case, whether or not they have to pursue it. Only question would be who files first in federal court ...
