Actually, on a Constitutional basis, the feds would have to challenge the law unless someone else with standing challenges it first. The concept of any state attempting to challenge federal jurisdiction has to be addressed, or the feds would be derelict in their duty. Think of it in terms of an unchallenged "easement." If you don't enforce, then others can try it too. The legal basis for the civil war was similar.So I can see that some droid had to do some paperwork just in case, whether or not they have to pursue it. Only question would be who files first in federal court ... |
