U.S. renters owe $21.5 billion in back rent; Republicans offer no eviction relief

NEW YORK (Reuters) - More than $21.5 billion in past-due rent is looming over Americans struggling to make ends meet, global advisory firm Stout, Risius and Ross estimated on Wednesday, as Republicans and Democrats fight over a new COVID-19 relief package.

Senate Republicans this week proposed a new plan that would not reinstate the recently-lapsed federal eviction ban, which carried a stay for rent due for one-third of renters. Adding to the strain, enhanced $600 weekly federal unemployment benefits are set to evaporate this Friday.

Without a solution soon, the likely result “will be a staggering surge in homelessness unlike anything we have seen,” said John Pollock, a Public Justice Center attorney and coordinator of the National Coalition for a Civil Right to Counsel (NCCRC), which helped develop the eviction tracking tool with Stout, Risius and Ross.

The unprecedented amount of back rent is not a macro-economic game changer, said Moody’s Analytics Chief Economist Mark Zandi. But for renters, “it’s catastrophic. Very few people will be able to pay this back,” he said.

A debt spiral could haunt displaced tenants “for a lifetime,” he added.

Over the spring and early summer, as unemployment surged to levels unseen since the aftermath of the 1930s Great Depression, a patchwork of federal, state and local eviction bans kept renters in their homes.

On Friday, the eviction ban that covered the third of renters in buildings with mortgages backed by the federal government lapsed. The rent deferred over four months is now due, as is all the rent where local and state moratoria on evictions have also ended.

When rent goes missing over such an extended period, the low-end of the market becomes a house of cards and “it starts to fall down,” said Emily Benfer, who co-created the COVID-19 Housing Policy Scorecard at Princeton University’s Eviction Lab, a national research center on evictions.

“Risk of eviction increases, risk of foreclosure and bankruptcy follows, property taxes go unpaid leaving communities and schools under-resourced,” said Benfer, a visiting law professor at Wake Forest University.

The Democratic-controlled House of Representatives passed a measure in May that would have extended the enhanced jobless aid through January and allocated $100 billion for rental assistance. It would also have extended the federal ban on evictions for up to one year.

The Republican-controlled Senate package unveiled Monday focuses on getting kids back in school, workers back to work and winning the fight against the virus, the Office of the Senate Majority Leader said in a statement.

It proposes cutting the enhanced unemployment assistance to $200 a week, and does not mention housing, evictions, or reinstating the eviction ban.

The Senate Republican Communications Center did not respond to requests for comment.

The Senate Banking Committee, which oversees housing, cited a statement by Senate Banking Chairman Mike Crapo (R-Idaho) on Tuesday.

“I can’t answer that yet,” he told reporters when asked about an extension of the eviction moratorium. “There will be something, I hope, dealing with rental assistance.”

An avalanche of filings are hitting eviction courts nationwide, as hearings ramp up again online, in courtrooms that require social distancing, and even at the Columbus, Ohio convention center. In July alone, 21% of renters paid no rent, according to research firm Apartment List.

Stout and the NCCRC analyzed census survey results and income data to create their eviction tracker, which uploads data weekly. Of the 44 million U.S. renter households, 17.3 million are unable to pay rent and risk eviction, the tracker estimates.

They've only been around since 1991. What are they going to know?

Reuters is getting worse, claiming that helicopter money is the norm. How about making the mayors and governors pay for these losses (that they ordered) out of their own personal wealth?

That’s a good question and I thought of the same thing. But at what point is there balance to keep landlords solvent? Not slumlords but the one who maintained their property during this disaster.
But what I really don’t like are the folks that think they don’t own anything and are trying to get over. That’s a problem.

It's a bad situation all around. Most landlords are not "corporations" and are at risk of losing their property if rent is not paid. But what will evicting tenants solve? From what I've seen, somewhere around 35-40% of tenants are behind on rent. Landlords would just be shuffling them around. What good would that do?

Let’s take the Democratic approach to this. Gov. Murphy, who is too busy keeping that gym closed, is fresh from allowing illegal aliens the ability to obtain drivers, professional and occupational licenses in New Jersey. He feels that “ These people (who are in this country illegally) should not face unnecessary barriers in obtaining these licenses.“ So while we’re forgiving student debt and providing professional licenses to people who are not legal citizens it’s a short hop to renters relief. Why should a person who rents an apartment be required to pay rent?

I agree there is a huge problem. Landlords can't go forever without getting rent, or they can't pay their taxes.

The bigger problem is people working”off the books.” They’re the first ones to brag at a party anxious to let you know that you’re a sap for declaring your earnings. But when a pandemic occurs, they are outraged that their deliberately reduced earnings yield a proportionately reduced unemployment benefit. Most working Joes would have been made whole with the extra $600 if they had reported accurately and, grab a chair for this, LIVED WITHIN THEIR MEANS. But who needs to do that when you’ve got Schumer and Pelosi galloping to the rescue screaming, “It’s not your fault!”

These rental properties are not owned by mega corporations, and even if they were, who cares?

I have a number of clients who are absolutely reeling right now. Most are husbands and wives who are lucky enough to own a multi-family dwelling. They have already seen their property values decimated by New York legislature imposing onerous regulations on landlords, and now they are struglling to pay their mortgage and taxes because they don't have rent coming in.

No good answer here. They obviously should try to get as much of the rent due out of their tenants as they can. But that might not be much if the tenants are really unemployed and the unemployment insurance has run out. And eviction risks getting zero rent thereafter.

There's a lot to be said for continuing the unemployment insurance checks for a while longer.

Not that it’s relevant, but the NJ governor’s mansion is not in Trenton, it is in Princeton Township. It is the only state in which the governor’s mansion is not in the state capital.

We'll see if the GOP, "the party of personal responsibility", allows enhanced UEI to continue, and in what amount, if at all.

Remember, as BB often says here, "whatever happens, good or bad is on you", not the government or anyone else. If you didn't die of COVID and you're now broke, you aren't "responsible", per the GOP.

Reality check: my landlady expects her rent in full, on the first of every month, even if I am suffering from gunshot wounds. The GOP doesn't comprehend that this is also the reality for millions of Americans. Yes, a landlord or landlady could lose their building if they fall behind on the mortgage, but that takes time. Eviction happens NOW.

Actually...this is a responsibility the government should live up to.

Think about it. If the government can bail out megacorporations, then the government can help ordinary Americans keep living indoors until the plague is over.

The minute the moratorium on rents went into effect landlords knew they were doomed. Every dollar that would have been “squirreled away” for rent found a million others places to be spent, or simply not earned. If folks knew from day one that they HAD to pay the rent or not have a home believe me the rent would have been paid and we wouldn’t have this latest eviction crisis. The landlords, with bills of their own to pay, were chosen as the soft touch patsies.
