When I use a cell phone I am allowing the carrier to know roughly where I am at all times that my phone is on. How is it 100% clear that the 4th Amendment prevents the government from asking that 3rd party where I've been without a search warrant?I don't disagree with the majority decision, but why do you say that a true strict constructionist couldn't possibly dissent? |
