BNSF Employee, Talking on Cell Phone, Killed by 79 MPH Train

A BNSF employee involved with a test train, talking on a cell phone, walked in front of a commuter train traveling at 79MPH. He did not survive. The territory is 2 main track CTC, with both tracks signaled for traffic in either direction.

A reminder to all who work around rails--your outlook for long term survival is not good if you allow yourself to be distracted. One of the best BNSF employees ever lost his life when he allowed a distraction to interfere with his safety.

Ain't gotta tell me!!! If, and this is a big IF I use the phone, I always stay well beyond the fouling distance (4 feet) from tracks. Good thing about our property there are plenty of places to clear up safely. But even so, I keep it for the stations, yard offices, or parking lots. Just not worth it!!! Now, this gentleman and colleague's family has to deal with the loss, which is always sad, no matter who/what is at fault.

Stay alive, stay safe, stay off the phone on the right of way!! Keep your attention focused at all times, and know what's going on around you at all times, be it main line or yard!!

sad , specially if you consider how much track separation there is (see photo). Cell phones have no place on Railroad.
Yet everyday I see track walkers, track maintenance people, flagman and even train men and conductors still on their phone. yakking or texting away as if no ban exists.
sadly this employee won't be last, and after each incident our rule book just gets a little heavier.
I do blame not onlt emplyeees but the lack of supervision for the lack of compliance.

Hit the nail on the head!!! I mean is it too much to wait until you are clear of the tracks to hit the cell???

Brace for the storm of memorandums, advisories and supervision lectures!! And I kid you not, as was discussed in the last rules class, don't be surprised if, in time, a Federal rulebook gets established, and yet another "brick" we will end up having to carry!!

The man was working with that three car set doing some sort of tests. It seems normal that he should be talking with the people that he was working with. It could have been a company phone or even a radio. Crossing the tracks, like driving a car, should be a full time occupation. One presumes this will show up on the NTSB in a year or so. Does anybody have access to the preliminary report?

NTSB does not handle Employee accidents.
And no internal reports do not normally get released except to FRA and lwyers.

If he was to use the phone, and the equipment is NOT in motion, he should have remained on the equipment, or got off and stood on the side of the right of way in the clear and conducted his business over the phone, not go walking on the right of way. Sad either way, but could have been prevented.

This is why the FDNY*EMS Operating Guide was getting thick like the Manhattan phone directory around the time I left...I hear tell that future editions of this rulebook will come on two DVDs...while those will be a lot easier to carry, THAT's a LOT of pages to scroll through!

An old chief I knew used to call the ever-growing Guide the Book of F*ck-Ups, because it did, as has been noted here, get thicker every time someone messed up.

Based on his failure to adhere to rules(FRA), his family will loose a big chunk of money when this gets to court.
FELA courts cases will always assign fault as percentage of cause to acident and awards are governed by this percentage.

No, does not matter whether the phone was company or personally owned. He should not have crossed the tracks while using it. I am pretty sure it is against FRA rules. This is why many RR's and transit agencies have signs that say things like: "Think Safety", "Safety First", and "Stop, Look and LISTEN". I don't think the NTSB will investigate as there were no public harmed in the incident and they don't get involved in employee accidenst.

With respect to the NEC, nobody should fly this weekend. Period. Anybody with a lick of common sense knows it is a mistake to be up there with Earl, and no, Earl could care less whether the airplane has wingolets or not. It makes no distinction. If people disregard this WARNING and insist on flying along the Atlantic they do so at their own peril. In that case, go with B6 as your carrier of choice. Those jetBlue pilots refuse to fly overwater because they are scared.

Can you imagine the grief of the person who called the BNSF employee at that moment? Knowing that it was your call that was the instigator of this man's death, and also hearing all of the events while listening or talking on the phone? Whether the call was work related or from a family member or friend, that has got to be heart-breaking.

Everyone has their opinions and they are entitled to them, nor have I thought I was better nor have I thought he was better than me or anyone else here!! And I never tried to compete with him or anyone!! I do, however, blow out of the water and thoroughly sink to the bottom of the sea, the select one(s) who try to think they are among the best here, and think they have the skills to allow them to criticize others, yet that select person(s) truly do suck at photography!!

And maybe someday when I learn and figure out Photoshop, I can move up to others levels here, instead of my practice of posting photographs that are unadjusted, other than slight darkening or lightening as needed and crops, and taken and displayed here how my eyes and camera saw at the exact levels of lighting they were seen as the day the photograph(s) were shot, and show a photo(s) that are good, and not perfect, or made to look like they are perfect by way of Photoshop.

Thanks for the compliment as well. I just share what I work hard to get, much as all others do here!! Nothing more nothing less!!

I have a nice program on my computer called Windows Photo Gallery, I'm not sure where it came from, maybe was pre-installed (I'm a dummy).
Anyway you cam do all sorts of things with your photos, brightness, saturation levels, shadow , crop, etc. It's fun to work worth.

I use a Dell Inspiron 530 with Windows 7 Home type.

Sorry LION I am using a Vista machine and it has Windows Photo Gallery on it, but I think u r correct in that XP did not have it next time I use my XP machine I will confirm for you.

This is a sad story. I've known several other similar cases during the years that I was on the railroad. Usually its the serious thoughtful guys who one day just don't happen to be paying attention or get preoccupied with other things. The railroad is a great place to work but it can also be a very dangerous one. You should always keep clear of the rails unless absolutely necessary and always expect a train to come at any, in any direction on any track. I feel for the poor guys family and friends.

Thanks, guys, I guess the Windows Photo Gallery program came with my computer.
Anyway I like it. I can't comment about Photoshop, maybe it's better.

I have Photoshop which would be better as far as advanced editing but the stuff that comes w/Windows is great for basic editing
