No, does not matter whether the phone was company or personally owned. He should not have crossed the tracks while using it. I am pretty sure it is against FRA rules. This is why many RR's and transit agencies have signs that say things like: "Think Safety", "Safety First", and "Stop, Look and LISTEN". I don't think the NTSB will investigate as there were no public harmed in the incident and they don't get involved in employee accidenst. |
