That brings it to a higher level IMO. |

For whatever it is worth, this country is constantly setting aside classes that are treated differently under the law. The concept of hate crimes, the concept of assaults on different kinds of workers, secret service protection for a wider and wider range of people, the examples are many. Some of them would make sense to most people, but they clearly are classist. It isn't just the ruling class, we have special rules for a whole host of folks. |

The rule, as it is written, doesn't make that distinction. It's very inspecific, so the carrier could use it to cover many possible situations. Some of the letter rules, like Rule G, are extremely specific in what is and isn't permitted.The guy's podcast and social media and T shirt sales also fall under the extremely wide net of Rules D and E. Keep in mind that these rules also have plenty of non-political applications, and that the MTA probably has a whole bunch of other tools at their disposal, in that CD-ROM they send me every couple of years that I never read. |

As for the sanitation guy, If he got arrested, he's done. If he didn't, he's only up against a sick leave violation. If he has no prior discipline on his record (as in first offense) and a good work record, he might get away with an unpaid vacation, and keep his job. Those are two big "ifs"But if he got arrested and was fired a/c the arrest, then gets acquitted or charges dropped, he could go to arbitration (thru his union) to try & get is job back. If he gets lucky, he wins & goes back to work...after about a 2 year wait to get his hearing and ruling. Either way, he'd be kickin himself in the ass for the rest of his life asking himself "was it worth it?" |

Running to EAP saying you needed the $$$ to support a bad habit always helped.The only way I've seen guys get fired & stay fired is fighting on duty & on company property. You duke it out with someone on the clock & both combatants can kiss their jobs goodbye. "Take it outside" might get you busted up, but at least you kept your job...to pay for your medical bills if need be. |

"Tripartite" doesn't ring a bell. The method used was known as a "system board" which involved a "neutral" (arbitrator), carrier (MN) & orginazation (union). Of all the 18 crafts what ran MN, each union had its own system board. From my years at MN, when it got to the arbitrator, the carrier had to have a pretty strong case for a dismissal to stick. |

"Disqualifiers" is the correct word. If an employee has "must have a valid drivers license" in his job description & loses his license, he would be automatically disqualified from that particular job. With that, he'd be entitled to displace (bump) a junior man based on the bid/bump seniority system allowed in his collective bargaining agreement that did not require a driver license. He's given 10 days to do this or he forfeits his seniority, aka unemployed.Bottom line here is that he loses his position, but stays employed. |
