That is tripartite arbitration. Arbitrator is paid (approx $2000/day) to decide. Most arbitration end 2 to 1 but some do end 3 to 0 when the union has had enough of the subject. At the end of the day, union and management usually have the same # of wins or the arbitrator will not be asked back
