Don't you have to hold down a "talk" button to work the Pa. on those trains?? Do we know for sure that the comment was not made by a passenger & picked up by the non-directional mike while the conductor was making an announcement??
Something don't sound right here.

If the PA system simply picked up a passenger saying that sure I'm sure the C/R would apologize right after... Probably was the C/R last trip of the day and he was annoyed that that kid killing himself delayed service, I'm leaning towards he said it, but didn't mean to say it over the PA so that everyone on the train could hear it.

Pure speculation here...maybe the C/R didn't realize that the remark was picked up on his mike while he was talking. If the passengers were making such a fuss, why didn't the conductor or maybe his assistant make an apology straightaway?
Bottom line, if the C/R made that remark, he should be fired, straight answer.
It just dosen't make sense that the C/R would blow an 80K job that way. Time for all the facts to come out before any rush to judgement

I'll give some speculation too. Whoever said it likely said it out of frustration. We all make frustrating remarks at one time or another that we may not really mean. How many passengers who were delayed that night may have felt so or said it to a fellow rider? Yeah, yeah, the employees are supposed to be held to a higher standard. But they are human. Maybe a dispatcher said it too because it jacked up his railroad for the rest of the night.

Employees have lives and families too. Sometimes the overtime money is not important. Maybe he had a doctor's appt.? Sometimes we wait months for a specialist and now he has to miss it. Or missing a dinner date with the wife or girlfriend for a special occasion. Or needing to finish on time because one of the kids are in a school play or a sports event.

Yep...& if the conductor is brought up on charges, they'll hit him with "He's been to revenue/training class & should know how to deal with situations like this, therefore based on that, his actions were inapropriate" Dismissal offense.

If thats the case, he's toast too. That remark would be on tape.

You don't know how the MTA deals when it comes to employee investigations. They'd love to fire a guy with say 20 yrs of seniority & replace him with a 70% er off the street w/o pension & minimal benefits.

The personnel office is up to here with resumes for trainperson positions.

Of course if the person is identified who made this statement, he is in for some unpaid time off. Even a 10 day suspension is 2 weeks pay.

But to fire him is strong. Not worth it to the railroad because it costs money to train a new employee. People get fired for stuff like padding the payroll and operational errors that have a negative monetary effect on the railroad (having to repair infrastructure). Times that by the number of employees you may want fired for other infractions vs. the public, training new employees for those fired wouldn't be justified. Suspend the employee: lesson learned.

I agree. A dismissal like that would be appealed & usually goes to arbitration & usually the charged gets re-instated.

Unless of course he has prior discipline on his record...then all bets are off

Not only that, but when re-instated typically back pay is awarded. At which point the MTA effectively paid two people for the same job over the same time. The prospect of this is why they don't respond to the public "hang 'em high!" sentiment and IMO is a good thing...
