The charges were most likely dropped for the same reason they are usually dropped when the police overreact -- there is not enough evidence to prosecute. In other words, it can't be proven that the law was broken.

So then the law could have been broken but in the long run the charge could not be sustained in court, does that mean that the police over-reacted or more accurately does it mean that the threshold for police action might be lower than in the courts where cooler heads prevail. Let me also remind you that had these two dancers mouthed off to the judge as they apparently did to the police, the judge would have held them in contempt. It's all a matter of who's shoes get spit on.

I do know that if the two stopped dancing, they would not have been arrested. Most likely they would have been responded to with a thank you, perhaps a warning or at worst a summons. The fact that they were arrested seems to indicate that it was more than dancing in the "aisle".

Not sure why you're trolling me in particular.

If a cop tells you to stop dancing on the platform, stop, and they'll probably just go away.

There are rules of conduct on NYCT property. It's reasonable to expect that dancing is not permitted on the platform.

How is pointing out that Alvin Ailey did a dance photo shoot in the subway, (without anyone getting locked up) "trolling" you?

The MTA Rules Of Conduct do prohibit, in 1050.6 (1), activities which obstruct the flow of traffic in facilities or conveyances. However, in the case of the couple in the OP, there was no traffic there to obstruct.

If the NYPD is going to lock people up for "obstructing traffic" in the subway, then, by all means, let the cops start arresting people who:

Stop dead in their tracks at the top or bottom of a staircase or escalator, as if they've never, ever seen a subway station before in their lives.

Hold the train doors open while 7, 8, or 9 of their traveling companions try to board the train.

Do pull-ups on the ceiling railings.

Among other things...

The rule is in place whether or not there is traffic to obstruct. It's a 24 hour rule. And in Manhattan, there is traffic at all hours of the night, which is why trains run 24 hours.

They probably got locked up for not stopping or becoming confrontational with the cop.

Unfortunately for the couple who were dancing on the subway platform, the 59th Street Columbus Circle station is home to NYPD Transit District #1 & the Borough Command HQ.

Hence why the back up arrived quickly in in force when the 10-85 call went out.

And yes, cops will lock up just about anyone if they get pissed off during a stop. Unfortunately the job makes many of them, NYPD uniformed personnel, cynical. They get it from the top, and from the bottom...
