I'm not surprised by what went down and what was repealed and NOT repealed however the conservatives sent a strong message to Washington by saying that the law should've stayed intact in the dissenting opinion that federal immigration laws are too lax and is apart of the problem.

OK, I get stopped for jaywalking in Phoenix. The cop asks, do I have proof I'm a citizen. I say no, but I was born in NYC. He has no right to detain me, does he?

Now suppose someone else speaks very little English, only Spanish, and says they were born in LA but can't prove it. The cop doesn't have any right to detain him either, does he?

As long as neither of us gets detained the law can stay on the books.

Or if both are detained. It becomes a problem only when the Spanish speaker is detained, you are let go. That's profiling.

That's what I said and meant. The state law giving the state the power to enforce a law which the feds have supremacy on was invalidated. The laws still criminalizing said behavior still exists, it's just federal, not state.

And the state has nothing to say about it if the state feels the federal government isn't doing enough to stop it. We're back to the pre-SB 1070 status quo, except it's clarified that there can't be another SB 1070. Also, being in the county illegally isn't a crime.

But if I am detained, I have the resources to sue for false arrest, since I'm not required to prove my citizenship. So they don't dare detain me. They only dare detain those who won't sue.

Yes.

In other words, the law of the land as it always was.

Only La Migra can detain or order the detention of people for immigration violations, not the Maricopa Co Sheriff Dept.

The only real change in the outcome is that Sheriff Joe and friends now have to drive them over to the federal building instead of Nutraloaf camp. They'll still be playing Gestapo now that it's been authorized.

Arpaio isn't smart enough to enforce the law in an evenhanded way. He'll get hit with a suit for selective enforcement soon enough.

If I were the ACLU I'd pay born Americans who don't speak any English to hang out on street corners without ID. Perfectly legal, and a red flag to Joe.

I forget whether it was CBS News or Disney news I saw him interviewed on earlier, he insists that he has a "secret weapon" to get around having to take them to the feds. Brewer was also extra chirpy about winning this one. Arpaio's gotten away with plenty so far, so I imagine he thinks he'll win this one too.

Wonder how the harvest is gonna go out there this fall?

That's the way I read it as well. It's almost as if Kennedy was inviting further legal challenges because he didn't feel that the current arguments carried enough weight, but he could see where it would go.

According to Reuters, Kennedy cited safeguards and limits written into the law.

He said an immigrant is presumed to be in the United States lawfully if a valid driver's license or similar identification can be produced. If an immigrant lacks such identification, the officer then checks with the federal government on the immigrant's status.

Still going to be interesting to see what's up Sheriff Joe's ... ummm ...

They can erase it by revising it in accordance with the SCOTUS opinion.
Then the boycott ends.

When you include Kagan (who recused herself from this case), this decision was really 6-3 and 7-2 against AZ rather than 5-3 and 6-2.

precedent is sealed for a while.

Here in upstate, Sheriffs know that fear of them keeps crime down. I don't blame him for getting the word out that there's no screwing around in his county. But geez. Boss Hogg wasn't a role model. :)
