I give the law until January 2015. Polls are showing that the Arizona electorate is moving from the extreme right to a more centrist position, and as such between now and the 2014 elections the legislature (and governorship) will move towards less extreme positions. I believe that someone is going to have the "bright idea" that the law is costing too much to defend from lawsuits and it will be removed without SCOTUS action.

What you don't always hear about is the fact that he goes out of his way to make life a living hell for anyone that runs against him. He'll use (or abuse) his powers to get every skeleton in your closet (and those of anyone you know) out into the open. Hence no credible candidate runs against him for fear of having their life ruined.

The problem is that Arpaio is the most powerful politician in the state and nobody in any position of power stands up to him because if they try to he'll abuse his power to make their lives miserable.

The one person that tried to stand up to him, Mary Rose Wilcox, just got a $975,000 settlement from the county.

A federal judge has awarded Maricopa County Supervisor Mary Rose Wilcox $975,000 to settle her claims against Sheriff Joe Arpaio and ex-County Attorney Andrew Thomas.

The claim stems from allegations of abuse of power and prosecutions and lawsuits motivated more by politics than criminal behavior.

The Arizona Republic says Wilcox was awarded the money on Friday.

Former County Manager David Smith reached an agreement on the settlement amount last month based on legal and cost analysis by retired Judge Christopher Skelly.

Skelly acted as a mediator for the county and determined that Wilcox’s settlement would be cheaper than litigating it in court.

A 2010 resolution approved by the supervisors gave Smith authority to negotiate settlements relating to legal claims in longstanding disputes between county officials and Arpaio and Thomas.

Yes, we agree. The court only considered the federalism issue.

What I'm saying is that it will take extremely intelligent enforcement of what's left of the law for it to pass muster with Justice Kennedy (and probably Roberts too). And intelligent enforcement and Joe Arpaio don't go together.
