What happens if you miss jury duty?

I've been summoned to Jury Duty in my legal home state of Arizona. However, I've been living in California since May of 2009 (but never became a California "citizen" as I intended to move back to Arizona (and still do) on short order). I postponed the Jury duty by 90 days from September to December but due to life's changes, I will not be able to permanently reside in Arizona the day that I have rescheduled the jury duty for.

What is the worst thing that can happen to me if I miss jury duty?

It depends on the judge.

I saw a story recently about a judge that got so fed up because a majority of people don't show up, that he summoned a bunch to hear their excuses, and either excused them or told them to show up again soon.

It's supposed to be illegal.

One thing to think about, possibly, is California versus AZ law. I don't know what Cali law is with how soon you are supposed to change over and become their "citizen", but I would wonder if you are just violating their law(maybe maybe not) and it would be valid for AZ as an excuse if asked in the future... It's not AZ's residency rules you're violating right?

I just didn't want to ever go through the hassle, and expense, of re-registering everything in California and then Arizona again. Technically, I'm violating California law now (but if I miss jury duty I'd be violating Arizona law).

Nothing. Unless they sent it registered mail. Otherwise you never got it.

Exactly. So I don't know if AZ is really going to throw you under the bus for violating CA law. I'm hoping that you have a valid excuse. Which might depend on why you're in cali temporarily.

Contact the commissioner of jurors IN ADVANCE of the date and explain your situation. You should be able to arrange for another reschedule since you're not a resident. Failure to do so will result in a bench warrant for your arrest that will be waiting for you the moment you step back inside the borders and get spotted by a cop and called in. DO work it out before it's too late. You HAVE an excuse.

wtf? Are you serious? A very significant number of people ignore the notices. How can you be arrested when they would not be able to prove that you ever received the notice?

Ninth Judicial Circuit statistics indicate about 50 percent of jurors summoned for jury duty in Orange are not showing up in court when they're supposed to. Court officials issue several thousand summonses each month for jury duty.

Many of the no-shows are the result of bad address information based on outdated driver's license details. In many cases, it's not certain whether the summonses are getting to the would-be jurors

Failure to obey the court is at minimum a misdemeanor in most states. However, rather than filing a criminal complaint, what the court does is issue a bench warrant for failure to appear. That's a misdemeanor everywhere. Ever hear cops on TV get back over the radio, "no wants, no warrants?" The latter is where this would fall. A bench warrant is enough to get you hauled in. It ain't GTA, but it's a crime.

They do not do that for jury duty. As OBS posted there are many notices that are sent out to the wrong address and otherwise not delivered.

In New York, and many other states, they do indeed. I'd be very surprised if California doesn't also issue a bench warrant for failure to appear. The SEVERITY of this may be another story, and I failed to mention that it can probably be thrown out if there's a valid excuse with proof. But courts DO take failure to appear seriously ...

Do they not have to send you some type of notice of a warrant? I thought they did.

I've never put myself there, only reason I know about it is I've done Jerry Doody too many times to count and the notice always spells out that stuff. One time I asked the clerk, "what happens if?" while there, and that's what I was told. Never wanted to find out. :)

There's absolutely nothing that they can do unless you admit that you received the notices. Does that not make sense? They can't prove that you skipped jury duty if you never got the notice and unless they sent it registered mail they have no proff that it was delivered. Nobody gets warrants for skipping jury duty.

And no, courts do not take failure to appear seriously because most of the people that fail to appear really never did get the notice. It is a problem but people aren't getting arrested for skipping jury duty. Every once in a while a cop wants to get on CNN and will take people from their homes straight to jury duty, but that's about it.

Maybe they do what scummy corporations and bill collectors do.

"If we don't receive it back as undeliverable we just assume it made it" I think there might be a legal precidant for that, but I totally don't remember where I saw it.

Probably nothing.
In the past, I have been out of the country for months at a time.
I would come back and there would be an old jury summons for a date that had already passed.
I would just call them up and tell them that i was out of the country for several months and that was that. They never verified if I was being truthful nor did they seem to even care.

With deference to terrorpin, perhaps Arizona doesn't treat it the same as New York ... NY would rather collect a fine rather than pay for your housing, but the exact penalties are at the discretion of the particular county's commissioner of jurors ... bench warrant is a certainty though. But you have to be wanted or charged with something else to get a guaranteed peepee whack for it ...

This is true, but they can still arrest you. You have nothing to fear if you never roll through a stop sign, or never go 5 mph over the speed limit. If you want to go through the hassle of being arrested when you get stopped for speeding, go right ahead and ignore the notice. Once arrested, you can start your "well I never got it" routine, but who wants to go through that hassle?

You can use that for your defense. But you still can get arrested. If you want to be bothered with that whole process, go right ahead, ignore it. A simple traffic stop can turn into a day or two ordeal....and then having to deal with defense.

Except that they don't issue warrants for people that don't respond to notices because:

1- A large number of people don't respond (OBS said almost 50%).
2- Most of those people have legitimate excuses for not responding (moved, wrong address, out of town, etc).

They send a nasty letter or two saying what can happen for skipping jury duty and that's it.
